Mrs Stella Matthews (representing Rhos Community Council) expressed concerns about the application.

Mr John Willcock (representing the agent) spoke in support of the application.


Several Members expressed concern that a scheme for the disposal of foul water had not been included within the report and suggested the inclusion of a further condition to ensure that such a scheme had been approved by the Local Planning Authority before development commenced. This was agreed by Members.

RESOLVED - That permission be GRANTED.

Conditions

1. Development hereby approved shall be commenced before 5 September 2007.

2. No part of the development shall be commenced until samples of all external facing and roofing materials have been submitted to and approved in writing by the Local Planning Authority. The development shall only be carried out in strict accordance with such details as are approved.

3. Development shall only be carried out in strict accordance with the approved plans or with any amendments thereto approved in writing by the Local Planning Authority

4. No part of the development hereby permitted shall be commenced until full details for both hard and soft landscape works for the site as edged red and for the hatched area beyond the site have been submitted to and approved in writing by the Local Planning Authority. The details shall also include boundary treatment details, and should include details for a lockable gate, to allow 'authorised only' access to the adjacent wildlife area. The works as subsequently approved shall be implemented in accordance with a timescale to be approved in conjunction with the scheme of details.

5. Before development commences, full details of the highway works to be implemented along Stryt Las, including the new footpath linking between the development and the existing pavement by Kwik Save, shall be submitted to and approved by the Local Planning Authority. The details as approved shall be fully implemented before any dwellings are first occupied, unless first approved in writing with the Local Planning Authority.

6. The visitor parking spaces shall be marked out in accordance with details to be approved in writing with the Local Planning Authority. The visitor spaces shall be fully provided before 50% of the apartments are first occupied.

7. No dwellings shall be occupied at the site until a Traffic Regulation Order to prevent on-street parking along sections of the highway between the junction between Stryt Las/Ruabon Road and The Conifers Nursing Home has been verified and implemented.

8. Before development commences a revised ecological statement shall be submitted to and approved by the Local Planning Authority to consider the implications of the amended site plan as submitted on 3 August 2005.

9. Development shall not begin until a scheme to deal with contamination on the site has been submitted to and approved, in writing, by the Local Planning Authority.

10.  Details of the proposed finished floor levels of the flats shall be submitted to and approved by the Local Planning Authority before any development commences on the site. The development shall only be carried out in accordance with the levels as approved.

11.  No part of the development shall be commenced until a scheme for the disposal of foul water has been submitted to and approved in writing by the Local Planning Authority. Development shall only be carried out in accordance with such scheme as thereby approved.

Reasons

1. To ensure that development commences within 2 years of approval of the reserved matters, to accord with Section 92 of the Town and Country Planning Act, 1990.

2. To ensure a satisfactory standard of appearance of the development in the interests of the visual amenities of the area.

3. To ensure that the development fully complies with the appropriate policies and standards.

4. To ensure a satisfactory standard of appearance of the development in the interests of the visual amenities of the area and to ensure that access is provided to allow management of the adjacent wildlife area.

5. To ensure that the site is served with a suitable means of access and footpath, in the interests of highway safety and to ensure that the site is appropriately linked to local services.

6. To ensure that adequate parking is provided within the site.

7. To ensure that the development does not cause on-street parking problems within close proximity of the site since the site.

8. To ensure that the mitigation measures within the statement relate to the site area of the approved development.

9. In order to ensure that any possiible contamination issues are adequately dealt with.

10. In the interests of the visual amenities of the area.

11. To avoid any risk of pollution of the environment.

Notes to Applicant

1. Before any development commences at the site you are advised to obtain necessary licence(s) under the provisions of the Conservation (Natural Habitats & c.) Regualtions 1994.

2. You are advised that the site is adjacent to a Special Area of Conservation (SAC) and a Site of Special Scientific Interest (SSSI), and any occupiers of the development are advised to consider the implications of these designations.

3. You are advised that any further applications to extend the commencement period of the permission is likely to require consideration of the latest planning policies for the area. As a result it is likely that affordable housing will be a requirement, and a financial contribution to schools may also be required. Other UDP policies and Local Planning Guidance Notes may also be applicable at that stage.

4. Based upon the former uses of the site, you are advised that it is important to consider issues of potential ground contamination at the site before any dwellings are occupied. Accordingly you are advised to contact this Council's Environmental Protection section (tel no. 01978 297041).

5. In respect of Condition 04 above, you are advised to ensure that a fence is provided along the edge of the site, to prevent unauthorised access to the adjacent wildlife area.

6 In respect of Condition 08, you are advised that the details within the ecological statement as presented by Cameron S Cook and Associates on the 18 May 2004 is acceptable in principle, but amendments are required to consider the revised layout and site plans as submitted on 3 August 2005.

7. Consideration should be given to an integrated systems approach for providing telecommunications for the development, to limit the need for occupants to have individual external satellite dishes / aerials, which can reduce the need for unsightly clutter on the building.

The Planning Control Manager reported that as the majority of the dwellings which rely on this public open space had already been occupied the Conditions 6, 7 and 8 should be reworded to ensure that the new works are implemented prior to the commencement of any further dwellings.

RESOLVED –

(i) That an obligation under Section 106 of the Town and Country Planning Act 1990 be required to provide for a commuted sum to be paid towards the future maintenance of the adjoining children’s play area, in accordance with Local Planning Guidance Note No. 10 and that the Chief Planning Officer be given delegated authority to determine the final form and content of the obligation
