G.1.b.CNon-Profit Leases at Less than Market Rents.

A.B. Maurer, Acting General Manager, R. Larson and T. Loat, Asset Management and Public Works Department, answered the Committee’s questions.

MOVED R. Noce:

That the Utilities and Public Works Committee recommend to City Council:

1.That the revised Non-Profit Leasing Guidelines outlined in Attachment 1 of the February 23, 1999 Asset Management and Public Works Department report be approved.

2.That the Administration prepare a bylaw amending City Administration Bylaw 11427 to:

a.Delegate to the City Manager authority to approve leases of City-owned property to non-profit organizations, for a term not to exceed 10 years, in accordance with the Guidelines and to sign all documents related to such leases;

b.Require that the City Manager provide a listing of the approved non-profit leases on an annual basis.

3.That the guidelines (Attachment 1) be amended as follows:

a.General Lease Terms and Conditions for Less than Market Rent Leases – On page 5, under the final bullet, the last sentence be replaced with the words “The City Manager will provide a listing of the approved non-profit leases on an annual basis.

b.Criteria for Qualifying Non-Profit Organizations – Onpage 6, under the final bullet the words “a less than market rent lease of parkland may be considered” be replaced with the words “the Asset Management and Public Works Department, the Community Services Department, and/or both shall prepare a report and bring it forward to the appropriate committee for consideration and determination.

4.That the report dated January 27, 1999 (Attachment 2) dealing with Non-Profit Leases at Less than Market Rents be received for information.
