ORDER ON THE LIST OF REGULATED CONSTRUCTION PRODUCTS

In pursuance of Item 1.1 of Resolution No 1482 of the Government of the Republic of Lithuania of 27 December 1999 ‘On the Appointment of Institutions Authorised to Approve Mandatory Product Safety Requirements’ (Official Gazette, 1999, No 114-3304), and in consideration of the mutual recognition principle established by Article 18(3) of the Law of the Republic of Lithuania on Construction (Official Gazette, 1996, No 32-788; 2001, No 101-3597; 2004, No 73-2545; 2007, No 55-2127):

  1. I hereby approve the List of Regulated Construction Products (hereinafter 'List of Regulated Construction Products') (annexed).
  2. I hereby determine that:

2.1.Conformity of regulated construction products must be assessed on the basis of the schemes and technical specifications indicated in the List of Regulated Construction Products, in accordance with the procedure established by the Technical Regulation for Construction STR 1.01.04: 2002 'Construction Products. Conformity Assessment and CE Labelling' as approved by Order No 187 of the Minister of Environment of the Republic of Lithuania of 18 April 2002 (Official Gazette, 2002, No 54-2140; 2003, No 51-2295).

2.2.The manufacturer or its authorised representative in a state of the European Union, country of the European Economic Area, or Turkey, must issue declarations of conformity (in the Lithuanian language) for construction products being placed on the Lithuanian market by referring to what is established in the harmonised technical specification for the product or, when no harmonised technical specification for the product exists, in pursuance of the requirements of the Technical Regulation for Construction STR 1.03.02:2008 'Declaring Conformity of Construction Products' as approved by Order No 189 of the Minister of Environment of the Republic of Lithuania of 18 April 2002 (Official Gazette, 2002, No 54-2142; 2008, No 47-1764).

2.3.Certificates of conformity, certificates of production factory control and test reports in accordance with the harmonised technical specifications indicated in the List of Regulated Construction Products shall be issued by notified bodies, after they perform all of the foreseen actions of conformity assessment.

2.4.Certificates of conformity, certificates of production factory control and test reports in accordance with other technical specifications indicated in the List of Regulated Construction Products shall be issued by designated bodies after they perform all of the foreseen actions of conformity assessment.

2.5. The list of Lithuanian designated bodies shall be approved by a separate order of the Minister of Environment.

  3. This order shall become effective on 30 July 2012.
  4. In respect of construction products the conformity of which is assessed in accordance with harmonised technical specifications, the List of Regulated Construction Products shall apply from 30 July 2012 or from the effective date of the harmonised technical specification indicated in this list.
  5. In respect of construction products the conformity (not in accordance with harmonised technical specifications) of which is being evaluated for the first time, the List of Regulated Construction Products approved by this Order, shall apply from 30 October 2012.

LIST OF REGULATED CONSTRUCTION PRODUCTS

NOTES AND EXPLANATIONS:

1)Requirements for construction products established in the List of Regulated Construction Products are indicated on the basis of Council Directive 89/106/EEC of 21 December 1988 on the approximation of laws, regulations and administrative provisions of the Member States relating to construction products, the provisions of which have been transposed through the Law on Construction and through technical regulations for construction. Construction products may be subject to requirements, not indicated herein, of other EU directives, regulations and legal instruments.
2)(D) - harmonised standard. The dates next to harmonised standards indicate from when the harmonised standard applies to the product.
3) ETA is a European Technical Approval prepared in accordance with guidelines (ETAG) approved by the European Organisation for Technical Approvals (EOTA).
4)A technical certificate or a company standard may also serve as the technical specification of a construction product.
5)Conformity assessment schemes are indicated on the basis of Annex 2 to STR 1.01.04:2002 (Official Gazette, 2002, No 54-2140).
6) Special requirements indicated in the standards apply depending on the manufacturer's declared area of use of the products.
7) NTA is a national technical approval prepared in accordance with STR 1.03.03:2008 (Official Gazette, 2008, No 47-1762). / * – date on which the construction product becomes subject solely to the indicated technical specification.
** – when this is foreseen in the technical specification for the construction product.
*** – conformity of cement with regard to alkali content is assessed in accordance with the methodology of the 25th Technical Committee of the Lithuanian Standardisation Department (LST TK 25) entitled 'Binders and Silicate Products'.
**** – it is necessary to determine the flammability class by testing in those cases where a flammability class other than FROOF(t1), FFL is being declared, or when the flammability class is not being selected from the tables of technical regulations for construction.
