Miners' Phthisis (Treasury Allowances) Act 1938
BE IT ENACTED by the King's Most Excellent Majesty by and with the advice and consent of the Legislative Council and the Legislative Assembly of Victoria in this present Parliament assembled and by the authority of the same as follows (that is to say):
1. Short title
This Act may be cited as the Miners' Phthisis (Treasury Allowances) Act 1938.
2. Provision as to rate of payment by Treasurer of allowances to sufferers from miners' phthisis

s. 3.
(1) Where the Treasurer is satisfied that any person as a result of mining for gold in the State of Victoria is suffering from miners' phthisis to such an extent as to incapacitate him from work and in the opinion of the Treasurer an allowance ought to be paid to such person, then such allowance shall be at the rate of $624[1] per annum or at such greater rate as is fixed from time to time by the Governor in Council by Order published in the Government Gazette:
Provided that, where payment of an allowance at such rate would disqualify the recipient for or reduce the amount of any pension allowance or other payment under any Act of the Commonwealth, then the allowance under this Act may be reduced by such amount as is necessary to obviate such disqualification or reduction.
(2) In this section "miners' phthisis" means silicosis whether alone or accompanied by tuberculosis, but does not include tuberculosis only.
