MEMORANDUM PRESENTED TO CHAIRMAN, CBEC THROUGH THE CHIEF COMMISSIONER, CENTRAL EXCISE, CHENNAI ZONE

Hon’ble Sir,

EXCISE DAY GREETINGS!

1. It has been reported in Excise Law Times Vol.244 dt. 28.12.2009 (pages A128 and A129- tidbits) under caption “Several posts lying vacant in Customs and Central Excise Department” that around 427 posts of Deputy/Assistant Commissioners are lying vacant and that this has been done in response to an application under RTI. You may be aware that Superintendents of Central Excise in this Zone have been serving in the same cadre for around 19 years and stagnating acutely leading to frustration and demoralization setting in them. This unit makes a very humble appeal to use your good offices and ensure that the correct status is ascertained and the vacant posts filled up immediately.

2. The distinction in qualifying service prescribed for promotion to next higher grade from the grades of Inspectors of Central Excise and Examiners of Customs is highly discriminatory. While both Inspectors and Examiners have been recruited through a common examination and that there is no scientific basis on which a candidate is allotted a specific service, it is iniquitous to prescribe 3 years for Examiners and 8 years for Inspectors for promotion to the next higher grade of Appraisers and Superintendents of Central Excise respectively. This in turn perpetuates a highly discriminatory promotion policy in respect of posts of Assistant Commissioners which is

done based on vacancy and a common All India seniority list in the ratio of 6:1:2 earlier fragmented by the DR ratio of 50%. This also signals the shift of CBEC from being an equal opportunity employer.

It is also humbly submitted that the above violate Article 14 of Constitution of India.

This unit requests that this discriminatory policy be revisited and justice done to the Central Excise feeder and base cadre of Superintendents and Inspectors.
