4-H is the Youth Program of Cornell Cooperative Extension delivered primarily through County Extension Associations throughout New York State. The educational and administrative resources of Cooperative Extension are available to non-chartered entities utilizing the 4-H Name and Emblem to further the mission of 4-H and extension programming. The 4-H Name and Emblem are protected under federal statute Title 18, U.S. Code 707 and in conducting such cooperative efforts, whether they be in fundraising, program development, scholarship or other activities, the use of the 4-H name and emblem shall be used exclusively for the character building and educational mission of 4-H. No unchartered organization may use the 4-H Name and Emblem that is not a party to this Memorandum of Understanding.

It is understood that:

I 4-H Staff will provide:

1.  Staff assistance in planning the programs, fundraisers or events including: ______

2.  Training for volunteers in selected programs, or events including: ______

3.  Program or fundraising supplies at cost, including: ______

4.  Loan of appropriate instructional or support equipment, including: ______

5.  Appropriate technical assistance, including: ______

6.  Publicity regarding programs will include mention of the affiliate involved.

8.  All affiliates will follow the F.O.R.M. Code 1501 Risk Management and Insurance Guide, with close attention paid to allowable and unallowable activities.

II Cornell Cooperative Extension of ______County will provide:

1  Inclusion on the master Comprehensive General Liability insurance policy if requested

2  Authorization to use the 4-H name and emblem for the following purposes:

3  Any needed background or driving record checks of affiliate members

III The ______(cooperating affiliate)______will provide the following:

1.  Proof of commercial general liability insurance if separately organized or incorporated. The insurance must meet the following minimums.

  1. $1,000,000 per occurrence/$2,000,000 general aggregate
  2. If affiliate is conducting any activities with youths the insurance must include coverage for sexual abuse and cannot have any exclusion for athletic participation.
  3. CCE of______County must be added as an “additional insured”.
  4. A Certificate of Insurance showing proof of all of the above requirements together with a copy of the endorsement showing CCE as an “additional insured” shall be provided at the inception of this MOU and upon renewal or replacement of said insurance.
  5. If the affiliate is added to the master Commercial General Liability insurance these conditions will be satisfied.

2.  Inclusion of 4-H Staff in any program, campaign or event planning including:

4.  Affiliate members are subject to the following:

8.  Publicity regarding any programs, campaigns or events will include mention of Cooperative Extension and 4-H as the source of the program.

9.  Financial reporting to Cornell Cooperative of ______county with same detail and transparency as that of a chartered club including at least annual reporting, use of an audit committee, a Treasurer’s record and recognition of gifts as outlined in the NYS 4-H Club Financial Reporting Guidelines.

10.  In the event of dissolution of _ (cooperating affiliate)___ all monies and assets revert to Cornell Cooperative Extension to be used exclusively for 4-H programming.

11.  Other

Affiliates meeting conditions III 1-9 will be considered eligible for MOU renewal upon agreements to any needed updates to this document.

Termination of the MOU can be made by either party with 30 days written notice. Termination of the authorization to use the 4-H Name and Emblem can be made by the Director of Extension or State 4-H Program Leader at any time for just cause.
