Membership Application (2016)
I hereby apply for membership in the Blue Ridge Swim & Tennis Club, Blue Ridge, GA, as indicated below. I understand that this membership is for the period starting with payment of fees due and expiring one year from the date below. I further understand that any fee paid with my application shall be returned to me in full and this agreement declared null and void in the event that my application is not approved. If approved, I agree to abide by the Rules and Regulations of the Blue Ridge Swim & Tennis Club and hereby acknowledge receipt of a copy of same.
I fully understand and acknowledge that: (A) outdoor recreational activities have inherent risks, dangers and hazards and such exist in my use of the swim and tennis facilities; (B) my participation in such activities and/or use of such facilities may result in injury or illness including, but not limited to bodily injury, disease, strains, fracture, partial and/or total paralysis, death or other ailments that could cause serious disability; (C) these risks and dangers may be caused by the negligence of the owners, employees, or agents of Blue Ridge Swim & Tennis Club, LLC, the negligence of the participants, the negligence of third parties, accidents, breaches of contract, the forces of nature or other causes. Risks and dangers may arise from foreseeable or unforeseeable causes including, but not limited to, such risks, hazards and dangers that are integral to recreational activities that take place in an outdoor or recreational environment; and (D) by my participation in these activities, I assume all risks and dangers and all responsibility for any losses and/or damages, whether caused in whole or in part by the negligence or other conduct of the owners, employees or agents of Blue Ridge Swim & Tennis Club, LLC, or by any other person.
I, on behalf of myself, my personal representatives and my heirs, or as a parent or legal guardian, hereby agree to use reasonable care and precaution in use of the swim and tennis facilities and voluntarily agree to release, waive, discharge, hold harmless, defend and indemnify Blue Ridge Swim & Tennis Club, LLC, and its members, agents, officers and employees from any and all claims, actions, losses or expenses (including but not limited to attorney's fees and court costs) for bodily injury, property damage, wrongful death, loss of services or otherwise which arise out of my use of the facilities at Blue Ridge Swim & Tennis Club. I specifically understand that I am releasing, discharging and waiving any claims or actions that I may have presently or in the future for the negligent acts or other conduct by the owners, agents, officers or employees of Blue Ridge Swim & Tennis Club, LLC.
I HAVE READ THE ABOVE WAIVER AND RELEASE, AND, BY EXECUTION HEREOF, I EXPRESSLY AGREE that this instrument may be treated as a waiver of liability and a defense to any action or proceeding that may be brought, instituted or taken by the undersigned or in his behalf, and shall forever be a complete bar to the commencement or prosecution of any action or proceeding whatSOever AGAINSTBLUE RIDGE SWIM & TENNIS CLUB, LLC, its owners, employees and agents, FOR PERSONAL INJURY, PROPERTY DAMAGE OR WRONGFUL DEATH.
