Mediation in the Third Sector

WhatisMediation?

Mediationcanbeausefulwayofsolvingadisputeoradisagreementandfindingasolution.Itallowsthepeopleinvolvedtomaketheirowndecisionsabouthowtomoveforwardforamorepositivefuture.Mediationisaflexibleprocessandcanbeusedinawidevarietyofsituations.

In the Third Sector it can be used when disputes have arisen or there are relationship difficulties between board members, committee members, employees or volunteers.

Mediationinvolvesanindependentthirdparty,themediator,assistingpeopletohaveadiscussiontohelpthemfindasolutiontotheissuesthattheyarefacing.Themediator helpspeopleworkoutandexpresswhattheirissuesare.Theythenhelptoconsiderwhat theoptionsareformovingforward.Theseoptionsarethendiscussedandusedtoworkoutanagreement.

Withthehelpofthemediator,thepeoplewiththedisputedecidewhethertheycanresolvethingsandwhatthesolutionshouldbe.Themediatordoesnottakesidesormakejudgements.Themediatorwillmakesurethateveryonegetsachancetotelltheirversionofevents,heartheotherside,workthroughtheissuesthatareimportanttothemandmake anagreement. Theparties tothe mediationare incontrol offinding thesolution.

Mediationisavoluntaryprocessandonlytakesplaceifeveryoneinvolvedagreesthattheywanttofindasolution.Itisaconfidentialprocesswherenothingwillbediscussedwithanyoneoutsideofthemediationmeeting,unlessagreedotherwisebyeveryoneinvolved.

Mediationcanbeapracticalalternativetomore formal methods such as grievance, complaints or employment tribunal.Ifthepeopleinvolvedareunabletoreachanagreement,theycanstillgotake forward more formal methodsifthisisappropriateinthecircumstances.Thedetailsofwhatwentoninthemediationwillnotbe discussedat subsequent formal hearings.

Whydopeoplechoosetomediate?

There are a number of reasons why people choose to mediate, including:

•they are worried about the costs or the delay in waiting for formal grievance or complaints processes

•theremay be outcomes that can be agreed which formal processes couldnotaward.

Ismediationsuccessful?

Yes–most mediations are successfulinreachingagreements,and peoplearemorelikelytosticktoagreementsmadeinmediationthanwhensomethingwasdecidedmore formally.

No-onecanforceyoutoparticipate in mediation,however,as itislikelythatitwillhelpyoutosolveyourdisagreement and as you can withdraw at any time it is usually worth trying.

WillIhavetodooragreetoanythingIdonotwanttodo?

No–theprocessofmediationistotallyvoluntary.Youdonothavetoagreetoanythinginmediationthatyoudonotwantto.

Isofferingtomediateasignofweakness?

No–thereisnothingtolosebyagreeingtomediate,evenifyoubelieveyouarein

therightorhaveastrongcase.Mediationwillhelpyoutofindasolutiontotheissue.

Howlongdoesittaketoorganiseamediation?

Youwillarrangethiswiththemediator.Itisnormallydowntoeveryone’savailability.

Whenisthebesttimeformediationtotakeplace?

Mediationcanbeconsideredatanystageinadisputeoraconflict.Mediationcanbehelpfulatanytimeifcommunicationbecomesdifficultorrelationshipsbreakdown.

Evenifyourdisputehasalreadybeenthrough more formal processes,youcanstillconsiderusingmediationatanystage,ifbothpartieswishtomediate.

WillIneedtosendanythingtotheMediator?

Themediatorwillletyouknowiftheyneedanydocumentsfromyoubeforethe

mediationtakesplace.

Ifyouwouldliketouseanydocumentsaspartofthediscussions,itissuggestedthatyoutakecopiesofthesewithyoutothemediation.

Wherewillthemediationtakeplace?

Thiswillbeagreedbetweenthepartiesandthemediator.Sometimesthemediatorwill have a venue available andothertimesaroomwill befoundin anotherlocation.Thiswillbearrangedbythemediatorandagreedwithallpartiesinadvance.

Howlongwillthemediationtake?

This dependsonthesituationandthepeople involved. Oncethemediatorhasdiscussed thesituationwithyou,theywillhaveabetterideaofthelikelytimeinvolved. Most mediations are completed within one day.

Whatwillhappenontheday?

Onthedayofthemediationmeetingyouwillallmeetintheagreedplaceattheagreedtime.The mediator may meet with you separately prior to any joint meetings. Themediatorwillintroducethemeetingandexplainwhatisgoingtohappen. Themediatorwillthenensurethateveryoneinvolvedhastimetoexplainthesituationandwhathasbeenhappeningfromtheirpointofview.Themediatorwillthenhelpyoutodiscusstheissueandtofindanagreementthateveryonecanlivewith.Shouldanagreement bereached,themediatorwillusuallywriteupwhathasbeenagreedandaskeveryonetosignit.

CanIleaveamediation?

Yes–atanytime,althoughmostmediatorswillaskyoutogivethemafewminutesbeforeyoudosotodiscussyourreasonsandtoseeifthereisanothersuitableoption.

CanIbringsomeonewithmetomediation?

Itdependsonthecircumstances.Youshoulddiscussthiswiththemediatorbeforethemediationtakesplace.

Doesmediationalwaysinvolveaface-to-facemeeting?

Itissometimespossibleformediationtotakeplaceusinganotherformat,forexample,overthetelephone or online.Yourmediatorwilldiscussthiswithyouanddecideonthemostappropriateformatforyoursituation.

THEOUTCOME

Whodecidestheoutcomeofthemediation?

Thepartiesdecidetheoutcomeofthemediation.Theroleofthemediatoristohelppartiesreachasolutiontotheirproblemandtoarriveatanoutcomethatbothpartiesarewillingtoaccept.

Whathappensifthereisnoagreementattheendofamediation?

Mediationisnotsuitableforeverycase,butitcanstillhelptosettlesomeoftheissuesinadispute.Ifappropriate,youcanstilltakeyourcasethrough more formal procedures if mediation doesnotwork.Alldiscussionsduring the mediationprocess are ‘withoutprejudice’–inotherwords,anythingsaidinthemediationcannotusually beusedlaterin formal proceedings.

COSTS

Howmuchdoesmediationcost?

Thecostsofmediationvaryanddependonthetypeofmediationinvolved,thetypeofdisputeandwhoisprovidingthemediation.

The Scottish Mediation Network, in partnership with SCVO, has arranged for special mediation rates to be offered to most organisations in the Third Sector.

Charity or voluntary organisation with an income up to £50,OOO / a pro-bono service will be provided for up to one day’s mediation at no cost
Charity or voluntary organisation with income between £50,000 and£250,000 / £300 (plus VAT if applicable) for up to one day’s mediation
All other Third Sectororganisations / £100 per hour (plus VAT if applicable)

In addition any accommodation or mediator’s travel expenses will be

agreed in advance and charged.

Fees are payable regardless of the outcome of the mediation.

Thelengthoftimethemediationwilltakeislikelytodependonthecomplexityofthedispute.Beforeyouagreetogoahead,amediatorwillbeabletogiveyouamoreaccurateideaoftimeandcostsforthemediation.

Whopaysforthemediation?

Ifthereisachargeforthemediation,thisisusuallysharedequally

betweenthepeopleinvolved or by their organisation.

DoI payifwedo not reachanagreement?

Yes–thefeeispaidforthemediatortofacilitatethemediation,regardlessoftheoutcome.Anagreementisreachedinthemajorityofcasesbuttherecanbenoguaranteeofsuccess.

THEMEDIATOR

Whatistheroleofthemediator?

Theroleofthemediatoristohelppartiesreachasolutiontotheirproblemandtoarriveatanoutcomethatbothpartiesareabletoaccept.Themediatorwillnottakesides.Thefocusofamediationmeetingistoreachanagreementthatbothparties areabletolivewith.

Mediatorscomefrommanydifferentbackgroundsandarealltrainedandexperienced

inhelpingpeoplesettletheirdisputes.

Whattrainingandexperiencewillthemediatorhave?

InordertobeaScottishMediationNetworkRegisteredMediator,mediatorsmustmeet practicestandards.Thesestandardsstipulateanumberofcriteriathatmediatorsmust satisfy before being admitted onto the Scottish Mediation Register:

•Adequate training from a trainer or team of trainers with appropriateexperience

•A requirement of initial mentoring or co-mediating to gain experience

•Post-training Continuing Professional Development (CPD) and practice

support

•Adherence to an appropriate Code of Conduct

•An appropriate system for addressing concerns and complaints

•Appropriate indemnityinsurance

No–ifyoufeelthatyoumayneedlegaladviceyoushouldmakeyourownarrangementsbeforethemediation.Themediatorisanindependentthirdpartyandmustnottakesides.Whilstyoumaybeveryopenwiththemediator,theywillnotofferanyadvice.

CanI have alawyer present?

Youmayfeel thatyourdisputeiscomplicatedandthatyouwouldpreferlegaladvicethroughoutthemediation.Ifyouwouldlikealawyertobepresent,youshoulddiscussthiswiththemediatorinadvanceofthemediation.

Inadditiontothemediationfee,ifyoudohavealawyerpresent,youareresponsibleforpayingyourownlegalcostsaswell.

Mostpartieschoosenottobringlegalrepresentationtothemediationandstillmanagetoresolvetheirdispute.
