MAYOR STEVE GEIGER CALLED THE MEETING TO ORDER AT 6:00 P.M.

PRESENT: MAYOR STEVE GEIGER, COUNCIL MEMBER KUNZEMAN, COUNCILMEMBER LARKIN, , COUNCILMEMBER ENGEL, COUNCILMEMBER OSBORNE

ALSO PRESENT: PLANNER BRUBAKER, ATTORNEY MARSHALL, ENGINEER OLSON, CHIEF CORNELIUS

DEPARTMENT REPORTS/UPDATES:

POLICE: Chief Cornelius reported that that we are slowly moving forward on our hiring process. We did give someone a conditional offer or employment this week pending the results of his Physiological and physical exams. Mayor Geiger asked about the police report regarding assists.

Surplus items that have already been approve plus some others, Also the 2005 Impala. Once the items have been declared surplus then we auction them off. What if items do not sell at the auction. They can be just gotten rid of.

Copiers and computers memory needs wiped out.

Motion to declare property on list surplus.

STREETS/PUBLIC WORKS: Engineer Olson gave an update on the Schweitzer Cut-Off Road/Sand Creek Bridge is moving along. They sent him a hydraulic structures report to look at. They sent Planner Brubaker a flood plain permit which is required for the work in the Sand Creek flood plain. JUB project manager is going to come talk to the utilities later this week. The Mayor and Engineer Olsen met with a couple of interested people who had some concerns about the capacity of the bridge and why we are only building two lanes when the rest of the road is three or more. They had some concerns that were weren't directly related to us. We sent them to Sandpoint. As a follow up to that meeting Engineer Olsen made a request for the traffic data from JUB. He received some response but not a direct response so he will continue to prod them.

Change Order for Emerald Automotive and Yamaha sewer service is Change order #2. Two items are utility conflicts with excavation and installation of the storm drain line. One was a water main that was not mapped. Our storm drain which is a very fixed grade hits it. According to Sandpoint it is a very difficult Main to relocate. They have been workable relocating another line. The easiest solution from a construction stand point is there is an opportunity to lower the storm drain line a little bit. That piece of this change order is about twenty five hundred dollars.

Second piece of the change order is a sewer lateral that exists on Bonner Mall Way just south of the intersection with Triangle drive. It is a pressure sewer for service that is common to Emerald Auto and Yamaha. It is very shallow and in direct conflict with the storm drain alignment. He has been told that there is no way to work around it. It will have to be relocated. In addition to that, KPSD has let it be known that they would like to see that service be split so that they are separate laterals. We have had some discussion with them. Engineer Olsen told them that we can relocate the line that is in conflict with our work but if there is additional work that needs to be done to bring it up to code that that would have to be paid for by somebody else. So we had the contractor break out the cost of 1) relocating the line and get it out of the way so we can do our project. That piece is $5,477.00. That portion is included in the change order. 2) split and replace both of the lines. The difference is an additional $1,630 that others may potentially pick up. Mayor Geiger gave the property owners a chance to speak to this issue. Brian from Emerald Auto said that if this is all that is required for them to split, he has no problem paying a little over eight hundred dollars as long as once these improvements are made that the new lower lateral which would feed into the main sewer system becomes jurisdiction of the KPSD. He does not want the liability of tearing up the street and sidewalks to change a lateral. Richard Trussell-Yamaha, commented on the work that had been done and signed off on twenty two years ago.

There was more discussion.

Motion to tentatively approve the change order contingent on the outcome of the special meeting of the KPSD Board and give the Mayor the authority to decide which change order that will be.

Councilmember Engel/Larkin. Roll Call vote. All voted in favor. Motion approved.

PLANNING, PARKS & COMMUNITY DEVELOPEMENT:

Compliance Violation #12-009 Birch Street. Mayor Geiger reported that he had driven by there today and thinks that it is cleaner than it has been. There are still two trailers and one old trailer that looks like it is full of trash and now they are down to one larger truck in the back yard. Things look like they have been mowed. There is a full pickup trailer sitting there with stuff in it. He would like to make sure that we keep the ball rolling on this. He would like Senior Planner Dan Carlson to call Jeff, the owner, and make sure that 1)we appreciate what has been so far 2)we need to continue to get rid of the oldest two trailers there. If the truck in the back yard is a nuisance violation than that would have to go too. Councilmember Engel asked how Mrs. Piatt feels about what has been done so far. They have made progress but she disagrees with just the older trailer. Because if you are living in fifth wheels it is a single family residence. Councilmember Larkin asked how many extensions are we going to give them before we take care of it. This has been going on for way to long. Mayor Geiger wants to keep on this. Mayor thinks that we should let the land owner know that if the trailers are not removed in ten days that we will tag them and have them removed.

Planner Brubaker updated the council on the TAP Grants, we were not successful for either grant. The match cover for those TAP grants is in the new budget and Engineer Olsen recommends that those funds be removed. Councilmember Larkin asked Planner when are we going to get the bags for the dog doo for the park. We have the bags and dispensers. He has someone lined up to dig some holes and set posts. This should happen within the next couple of weeks. He has also put in an order for the Sheriffs inmate labor crew to weed eat the new pathways.

PUBLIC COMMENT: Brenda Thompson-Ponderay is concerned about the laterals being replaced. She thinks that the City council putting in the bike pathway is a great idea but now the business owners/property owners who have not had any sewer issues, it was not broken, now they are going to incur an expense to upgrade and bring it to code when it was in Code when they put it in twenty years ago. Now this pathway is going to create an expense for them because the City is making the improvements. She does not feel that this is fair for the property owners. Val Syth agreed. Nancy Piatt-Ponderay asked KPSD representative is the rules that say that the laterals have to be split is a KPSD rule or a state rule? If the property is sold what does the KPSD require? There was more discussion on the sewer laterals. We will get together with KPSD and see if we can set up a meeting.

BUDGET WORKSHOP: The council addressed the entire budget.
