Participation Agreement Waiver

Including Assumption of Risk and Release From Liability

I, ______desire to participate & compete in the Advanced Cheer All Starz Cheer Program.

1.  I understand that participating in the sport of cheerleading is entirely voluntary and involves physical exertion and the risk of consequential injury. I realize that any sport activity involves some elements of risk, which I agree to assume. I will conduct myself in a safe and prudent manner while participating in the sport. Moreover, I am fully informed or otherwise aware of, and full assume all risks to person or property in connection with my participating in the sport (including, but not limited to damage and loss of property, bodily injuries, medical treatment and death).

2.  I am in good physical and mental health and do not have any physical or mental conditions which could affect my ability to participate in the sport. I am also aware that Advanced Cheer Coaching Staff/ and or affiliates will call 911 for emergency situations.

3.  I have medical insurance coverage appropriate for my participation in the sport and have provided emergency contact information to the Advanced Cheer All Starz owner/ coach. I understand and agree that Advanced Cheer All Starz shall not provide any insurance for me in connection with my participation in this sport.

4.  I including my parents, heirs, executors, administrators and assigns do hereby agree and will release, indemnify and hold harmless Advanced Cheer All Starz, its employees, agents, successors and assigns, singularly and collectively, from and against any blame and liability for any injury, harm. Loss inconvenience or any other damage of any kind whatsoever, which may result from or be connected in anyway to my participation in the sport.

5.  I hereby give permission to Advanced Cheer All Starz Program to use my name and any photograph taken of me during the Program, without compensation, in any promotional materials and publications, imprint or any digital medium (e.g. website), related to the activities of Advanced Cheer All Starz. I further understand that Advanced Cheer All Starz coach/owner and other coaching staff, does not assume responsibility for any loss, injury or damage to person or property in connection with the sport, including transportation to and from, which results from causes beyond the control of, and without fault or negligence of Kristi Shaw-DBA Advanced Cheer All Starz and will not be legal responsible to me for any death injuries, losses, expenses, inconveniences, delays of property damage that I may suffer as a result of such travel arrangements or activities.

6.  I absolve, indemnify, defend and hold harmless Kristi Shaw and Coaching staff DBA- Advanced Cheer All Starz from any breach of these representations.

I HAVE READ AND UNDERSTAND THE ABOVE PROVISIONS AND AGREE TO BE BOUND TO THE TERMS FOR ACADEMIC YEAR, AS INDICATED BY MY SIGNATURE BELOW.

______Monthly dues are due by the first practice of every month..

(example: Sept. fees will be due by sept 5th/ 6th depending on my athletes practice times.)

______I understand that if there are any dues not paid on first practice of the month it will result in a Charge to my card or the checking account if I so choose to put one on file.

______If any other fees given to me (uniform, bow, competition fee, etc.) are not paid on or before date given to me, it will result in a charge to my credit card or checking account if I so choose to put one on file.

______I understand that should, my check I write for monthly dues or the bank debit transaction from my signed agreement for monthly dues or any other ACC expense, comes back from my bank as unpaid, I will be responsible for paying $38 in addition to the amount of the check.

______If a check or bank transaction comes back as unpaid, ACC will no longer accept checks from me for the entire year, I will be required to pay the rest of the year in cash.

______I understand that my commitment with ACC is September 2017 through May 2018. If I chose to quit the team, it does not release me from my financial obligations agreed upon. I will continue payment until May 2018, including all competition fees and monthly dues.

______I understand that the decisions of team placement for my child are at the coaches discretion of the coaches made for the best of the whole gym. I agree that I will not question their decisions on team placement or placement of my child in the routines.

______I understand that my athlete is to wear a black top/ tank top and black spankies/ shorts and white cheer shoes to practice. No street shoes will be allowed on the cheer mats.

______I understand that my cheer shoes will not be worn outside of the gym or competition arena.

______If my cheerleader has to miss practice for a school sponsored event, coaches need to know at least one week in advance. Please email days to

______I understand that I or any other visitor will NOT sit in the gym to watch practices. There is a sitting area for parents and visitors upstairs.

______If my child has to miss practices for ANY reason in the two weeks prior to competing, it will be at the discretion of the coaches on whether or not my child will perform at the upcoming competition.

______All fundraisers completed with the group or on my own using the ACC name, will give 10% of all profits to the gym. NO FUNDRAISING REPRESENTING ACC FOR ANY individuals may be done unless it has been approved with Coach/Owner prior to. The owner of the gym reserves the right to advertise each fundraiser as she sees fit! All costs for this advertisement will come out of profits.

______If a check I receive for a fundraiser that comes back as unpaid, I will be responsible for collecting the amount of the check PLUS the $38 bank fee otherwise, this amount will come out of the profits I make from that fundraiser.

______I understand that all Rec prep teams will walk in the Arkalalah parade. Athletes will wear ACC gear or black/ purple gear. Parade date will be October 28th, time is TBA.

______I understand that my Athletes team will perform at atleast one competition and at the end of the year showcase. (teams arrival and performance times are TBA after team placements have been announced)

______I understand that there will be a competition fee for the competition we will attend.

______I understand that travel arrangements for my athlete to the competition will be my responsibility.

______24 hours prior to a competition I am not to contact the coaches regarding items forgotten (ex. Shoes, hair bow, uniform). I am to take care of these issues myself. This excludes emergencies including hospital visits and things of that nature.

______For up to 24 hours following a competition I am not to contact the coaches about concerns regarding events at the competition. (ex: a parent upset with something that was said or done by the coaches or other parents at the competition.)

______All hair coloring must be a neutral/ natural color unless otherwise pre-approved by coach Kristi.

______If for any reason my child’s competition fee is not paid prior to him/ her competing, any award won for that competition will not be given out until fee is paid in full.

______My child is to have white no show socks to compete in.

______I understand that after competing at the competition my athlete must continue practicing for the April/ May 2018 showcase.

______I understand that I will not make any post on any social media website negatively regarding ACC, its coaches, cheerleaders or anything that happened at a practice or competition.

______I understand that if I send the coaches any picture, tag them on a picture or upload one to our ACC parents page, I am giving them rights to use that picture for any ACC promotion, flyer or social media.

______I understand that I will not use the Advanced Cheer Crew, ACC name or any team name in my social media name without permission from the owner first.
