MANDATE AND AGREEMENT FOR THE PAYMENT OF FEES AND DISBURSEMENTS

WILLEM COETZEE ATTORNEYS confirm that:

1.Our fees will be calculated in accordance with the fee sheet printed on the overleaf and be subject to VAT, and further as reviewed from time to time (annually). The Supreme Court tariff or any other statutory or prescribed tariff will not apply.

  1. We will account to you on a regular basis, with regard to the progress of this matter as well as the fees payable.
  1. We require a deposit of R______ and reserve the right to call for further deposits from time to time, as the matter progresses.
  1. Payment of any account is to be effected upon rendering thereof. We are hereby authorized by yourself to incur all reasonable expenses, in the handling of this matter on your behalf, and to pay same. We further reserve the right, and are hereby irrevocably authorized by yourself, to appoint advocates, experts and consultants, in connection with this matter, and you will be liable on demand, for the payment of the fees of any such person.
  1. Disbursements incurred on your behalf will be reflected on your statement of account.
  1. If our fees and disbursements are not paid timeously, then we reserve ourselves the right at any point in time, to withdraw from this matter or any other matter that we may be handling on your behalf or to terminate further activity on your behalf until all our accounts has been paid in full.
  1. We reserve ourselves the right to claim interest at the rate of 2,5% per month on any outstanding account.

8.1In the event that a dispute arises, our account (including any adjustment thereof) will be subject to assessment by an assessment committee of the Law Society of the Northern Provinces, mutatis mutandis, in accordance the procedure provided for in Rule 80;

8.2The decision of the assessment committee will be regarded as final and binding and both parties who will be legally bound by this decision, notwithstanding the higher or lower assessment thereof.

8.3Any party would have the right to take the decision of the assessment committee on review to the Council of the Law Society in terms of the provisions of Section 67(2) of the Attorneys Act, 53 of 1979, subject to the right of review in terms of Rule 80.4.4 of the Rules of the Law Society.

9.I hereby exempt Willem Coetzee Incorporated and/or employee’s and/or agents of all liability and indemnify them against any liability of whatever nature [including consequential- or special damages of any kind] that originates directly or indirectly from any prejudice or damages suffered by me, as result of any and all services rendered to me by Willem Coetzee Incorporated, in terms of this instruction or otherwise.
