Magistrates' Court Civil Procedure (Amendment No. 24) Rules 2008

The Chief Magistrate together with 2 Deputy Chief Magistrates jointly make the following Rules:

1 Object

The object of these Rules is to amend the Magistrates' Court Civil Procedure Rules 1999 to make further provision for costs payable in matters and proceedings before the Court.

2 Authorising provisions

These Rules are made under section 16 of the Magistrates' Court Act 1989 and all other enabling powers.

3 Commencement

These Rules come into operation on 1 January 2009.

4 Principal Rules

In these Rules, the Magistrates' Court Civil Procedure Rules 1999[1] are called the Principal Rules.

5 Amendments to Appendix A

(1) In item 1 of the Scale of Costs in Appendix A to the Principal Rules—

(a) in paragraph (a), for "158" substitute "164";

(b) in paragraph (b), for "331" substitute "344";

(d) in paragraph (d), for "486" substitute "506";

(e) in paragraph (e), for "605" substitute "629";

(f) in paragraph (f), for "728" substitute "757";

(g) in paragraph (g), for "870" substitute "905".

(2) In item 82 of the Scale of Costs in Appendix A to the Principal Rules—

(a) for "$223" substitute "$231";

(b) for "$1563" substitute "$1618";
