Citation,commencementandinterpretation

  1. —(1)TheseRegulationsmaybecitedastheLocalAuthorities(StandingOrders)(England)(Amendment)Regulations2013andcomeintoforceon***2013.

(2)IntheseRegulations,

“the1993Regulations”meanstheLocalAuthorities(StandingOrders)Regulations1993([b]);

“the2001Regulations”meanstheLocalAuthorities(StandingOrders)(England)Regulations2001([c]).

Amendmentsrelatingtodesignatedindependentpersons

  1. Subjecttoregulation5,thefollowingprovisionsinthe2001Regulationsarerevoked—

(a)regulation6(standingordersinrespectofdisciplinaryaction);

(b)regulation7(investigationofallegedmisconduct);

(c)regulation10(transitionalandconsequentialprovisions);and

(d)Schedule3(provisionstobeincorporatedinrespectofdisciplinaryaction).

Amendmentsrelatingtoapprovalofdismissal

  1. —(1)Schedule1tothe2001Regulations(provisionstobeincorporatedinstandingordersrelatingtostaff)isamendedasfollows.

(2)Forparagraph4(1)of—

(a)PartI(authoritywithmayorandcabinetexecutive);and

(b)PartII(authoritywithleaderandcabinetexecutive),

ineachcasesubstitute—

(1)Whereacommittee,sub-committeeorofficerisdischarging,onbehalfoftheauthority,thefunctionof—

(a)theappointmentofanofficerdesignatedastheheadoftheauthority’spaidservice;or

(b)thedismissalofanofficerdesignatedastheheadoftheauthority’spaidservice,astheauthority’schieffinanceofficer,orastheauthority’smonitoringofficer,

theauthoritymustapprovethatappointmentbeforeanofferofappointmentismadetothatpersonor,asthecasemaybe,mustapprovethatdismissalbeforenoticeofdismissalisgiventothatperson.

(3)Forparagraph4ofPartIV(authorityoperatingalternativearrangements),substitute—

4.Whereacommittee,sub-committeeorofficerisdischarging,onbehalfoftheauthority,thefunctionof—

(a)theappointmentofanofficerdesignatedastheheadoftheauthority’spaidservice;or

(b)thedismissalofanofficerdesignatedastheheadoftheauthority’spaidservice,astheauthority’schieffinanceofficer,orastheauthority’smonitoringofficer,

theauthoritymustapprovethatappointmentbeforeanofferofappointmentismadetothatpersonor,asthecasemaybe,mustapprovethatdismissalbeforenoticeofdismissalisgiventothatperson.

(2)Inregulation2(interpretation)—

(a)omitthedefinitionsof“alternativearrangements”and“councilmanager”;

(b)afterthedefinitionof“chieffinanceofficer”insert—

“committeesystem”hasthesamemeaningasinPart1Aofthe2000Act ;

(c)inthedefinitionof“electedmayor”,“executive”,“executivearrangements”and“executiveleader”for“PartII”substitute“Part1A”.

(3)Inregulation3(executivearrangements–standingordersrelatingtostaff,proceedingsandbusiness)—

Transitionalprovisionrelatingtodesignatedindependentpersonsandapprovalofdismissal

  1. —(1)Where,beforethedateonwhichtheseRegulationscomeintoforce,anythingwasbeingdoneinrespectofanallegationofmisconductinaccordancewith—

(a)regulation7ofthe2001Regulations,includingthatregulationasappliedbyregulation10(1)(b)ofthe2001Regulations;or

(b)theprovisionssetoutin—

(i)paragraph4ofPart1ofSchedule1tothe1993Regulations;or

(ii)Schedule3tothe2001Regulations,

(orprovisionstothelikeeffect)incorporatedinthelocalauthority’sstandingorders,

theprovisionsmentionedinparagraphs(a)and(b)shallcontinuetoapplyinrespectoftheallegationofmisconductinquestion.

(2)AlocalauthoritymustmodifyitsstandingordersinaccordancewiththeamendmentsmadetoSchedule1tothe2001Regulationsbyregulation3nolaterthanthefirstordinarymeetingofthelocalauthorityfallingafterthedayonwhichtheseRegulationscomeintoforce.

(3)Anythingwhich,beforethedateonwhichthelocalauthorityincorporatedormodifiedprovisionsinstandingordersinaccordancewithregulation3,wasbeingdoneby,toorinrelationtoanofficerinaccordancewithaprovisionmentionedinregulation3,maybecontinuedafterthatdateby,toorinrelationtothatofficerinaccordancewiththatprovision.

EXPLANATORYNOTE

(ThisnoteisnotpartoftheRegulations)

TheseRegulationsamendtheLocalAuthorities(StandingOrders)(England)Regulations2001(“the2001Regulations”),whichrequirecertainlocalauthoritiesinEnglandtomakeormodifystandingorderssothattheyincludecertainprovisionsrelatingtostaffandothermatters.

Regulation2removesregulations6and7of,andSchedule3to,the2001Regulations.Thoserequiredthestandingordersofcounty,district,andLondonboroughcouncils,theCommonCounciloftheCityofLondonandtheIslesofScillytoincludecertainstepsbeforesuchacouncilcoulddismissordisciplineitsheadofpaidservice,monitoringofficerorchieffinanceofficer.Regulation3alsoremovesthetransitionalprovisionsinregulation10ofthe2001Regulations.

Regulation3amendsSchedule1tothe2001Regulationstorequirethatthedismissalofanauthority’smonitoringofficerorchieffinanceofficer,aswellasthatoftheirheadofpaidservice,mustfirstbeapprovedbythefullcounciloftheauthority.

Regulation4makesamendmentstothe2001RegulationsconsequentialonPart3oftheLocalGovernmentandPublicInvolvementinHealthAct2007,whichprovidedforthediscontinuanceofthemayorandcouncilmanagerformofexecutive,andPart1oftheLocalismAct2011,whichprovidedforlocalauthoritiestoadopteitherexecutivearrangementsorthecommitteesystem.

Regulation5makestransitionalprovisionsinrelationtoregulations2and3.

NoimpacthasbeenpreparedinrelationtotheseRegulationsbecausenoimpactontheprivateorvoluntarysectorsisforeseen.
