MINUTES FOR BOARD MEETING

April 10, 2017

Attendance:

Board members: Dick Dayton, Rick Southworth, Kathy Menk, Ann Bacher & Gerald Vanderpoorten

ARC committee members present: Theresa Moulse, Shelby Kettle, Ba Porterfield & Andy Furr.

Residents present: Dan Gormley, Harold Crosby, Pat Sullivan, Sylvia Womack, Fred Blake, Frank Rikard, Paul Neenan, & Jerry Dubose.

POA Board Meeting-

Dick Dayton called the meeting to order at 9:00 a.m with an invocation.

BCSS –Dan Gormley

Our attorneys have been busy the month of March. They spent about 18 hours preparing the Class Action suit; responding to the Motion to Dismiss by BCSS; drafting the motion to certify the Class Action; updating the Golf Club litigation matters; reviewing files of evidence to be used at trial; drafting subpoenas for records from Riviera Utilities, Gulf Shores Utilities and Robertsdale Utilities; drafting a list of witnesses to subpoena including C. Burke, Jr and M. Delaney and Drafting version one of the exhibits list for trial. The attorney fees for this work at $200/ hour came to $3,596.00 and as agreed upon we were billed at the $100.00/hour rate which came to $1,798.00.

Our Trust Account had a cash-on-hand balance of $1,569.42 and when the $1,798 was deducted, we have a balance due of $228.58. Therefore, it is time to put another $5000 into the Trust. An email showing the prorated cost sharing has been sent to the POA Officers, the Golf Club representative and the Sewer Committee members.

The next court date is April 18 at the Bay Minette Courthouse. The attendance at the hearing will be the responsibility of the POA, Golf Club officers and Sewer Committee members.

Lot A 20 – approved Direct Dish

Lot A 29 – approved placing Adopt A Bike surrounded by palm trees in yard

Lot B 54 – approved new patio and screened in porch

Lot B 83 – approved new fence

Lot B223 – approved Estate sale

Lot B247 – approved new roof

Lot B275 – approved Covered rear porch and patio additions

Lot B277 – approved new front door – same color

Lot C 18 – approved placing Adopt A Bike surrounded by hedges in front of electrical box

Lot C 27 – approved repainting house & doors – original color

REMEMBER: If you make a change to your home without approval and it is not acceptable to the ARC Committee, you will be asked to make approved changes. This includes tinting or painting driveways, roofing, concreting and other projects.

Please get approval from the ARC Committee before you make any changes to your property, even if it is just a replacement of a current item or color.

Lake Muriel Chairman – Harold Crosby

There has been an increase of illegal fishing by persons who are not residents. Please call the police at

943-4431 if you observe anyone who is not a resident of Lake View Estates or The Villas, fishing in the lake.

The Villas agreed to help Lake View Estates with the maintenance of the lake and they are now allowed to use the lake and the Pavilion Park. We welcome their assistance. A sign at the Pavilion Park will be added to state this change.

Lake Muriel Island Committee – Harold Crosby

Harold will poison the Chinese Tallow (Popcorn) trees on the island in the next few weeks. They are invasive and will destroy the natural habitat. The trees will take close to 3 months to die.

Welcoming Committee – Reported by Kathy Menk for Linda Terry

There were no new residents to contact. In the next month, there will be at least 5 new residents.

Beautification Committee – Sylvia Womack, Fred Blake & Bob Elick

Sylvia reported that they will plant new flowers next week, now that frost is no longer a threat.

The board approved the addition of a sprinkler system for the entrance in May. Newberry Landscape will install it at a cost of $2,100. The power box has been installed by Osborne Electrical for $100.

Lake View Gardens – Dick Dayton

This is the 94 lots addition behind Fairway Drive / Wedgewood Dr

Dick Dayton has tried to contact the new owners by phone and has had no success. He will send a registered letter to the 2 new owners of the property to see if they will agree to adopt the Lake View Estates covenants for that subdivision. If not, Lake View Gardens will have to be removed from our bi-laws and we will have no say in that development.

Financial Report for February, 2017 –Kathy Menk

The March financial report was approved. See attached.

Old Business:

1. Fishing: The general public is not allowed to fish in this private lake.

If a Lake View Estate or The Villas resident allows a guest to fish, the resident must accompany

the guest.

2. IF YOU SEE ANY SUSPICIOUS CARS AT THE PAVILION AFTER DARK, PLEASE CALL THE POLICE

TO INVESTIGATE (251-943-4431).

3. Residents are reminded not to discard their dog’s excrement in the garbage cans at the Pavilion Park.

4. Report any dog/cat issues to the City of Foley. They will investigate the problem, talk to the owner and

enforce the leash law if necessary.

5. Report street light outages to Baldwin County EMC (989-6247). Give them the ID number on the light and

they will replace them quickly.

New Business:

1. Lake View Estate POA Dues will be $118 and due the month of May. The form will be in the Homeowner

Packets for the Annual Meeting.

2. PLEASE TURN IN YOUR PROXIES FOR THE ANNUAL MEETING BY MAIL OR TO A BOARD MEMBER

BY SATURDAY, APRIL 29. NO PROXIES WILL BE ACCEPTED AT THE MEETING.
