Regular Meeting

April 26, 2016

6:30 P.M.

Open Meeting: Chairman Orr opened the meeting with the pledge of allegiance at 6:30 p.m.

Roll Call of Members: Present: Orr, Worden, Milton, Barrett, Kern and Kilroy. Absent: None.

Also Present: Neil Erickson-Zoning Administrator/Building Official, Deputy Clerk Blaszczuk.

I.  Approval of Agenda-Regular Meeting/Public Hearing

Barrett motioned to approve the agenda as presented. Seconded by Worden. Motion Carried.

II.  Approval of Minutes March 22, 2016, February 23, 2016 and January 26, 2016

Milton motioned to approve the minutes with the correction of the spelling of his last name. Seconded by Barrett. Motion Carried.

III.  New Business

A.  Public Hearing: Home Occupation: Jonathan Larson 74-25-006-1005-001: 7085

Lapeer Rd.

Orr opened the public hearing at 6:32 p.m.

Larson explained he is applying for his Federal Firearms License and that he needs approval from the township to obtain that license. He would like to have firearms purchased by other people on the internet shipped to him and then after background checks he will have the purchaser pick-up the firearms.

Worden asked if there will be any range or shooting activities. Larson advised no other than his own personal shooting.

Larson advised that he has no plans to buy or sell ammunition.

Orr closed the public hearing at 7:02 p.m.

Worden motioned to approve the home occupation use at 7085 Lapeer Rd with no more than 2022 square feet to be used for the business and pursuant to all federal requirements. Seconded by Barrett. Roll Call Vote: Yes: Worden, Barrett, Orr, Milton, Kern and Kilroy. No: None. Absent: None. Motion Carried.

Barrett motioned for Chairman Orr to sign the agreement. Seconded by Kern. Motion Carried.

B.  Public Hearing: Soil Removal Application: Joann Goll: 74-25-023-2037-000: Allen Rd.

Orr opened the public hearing at 6:39 p.m.

Goll explained that this is not going to be a full time operation. They only want to get rid of the sand from the pond. The pond is 4.5 acres because after 5 acres the DEQ gets involved.

Erickson advised that there is a permit for the pond.

Marty Torello advised that they will use an excavator and a loader to fill the trucks and also to finish the pond.

Chairman Orr advised that 3 people called the office and advised that they are not against the operation.

Orr closed the public hearing at 7:09 p.m.

Barrett motioned to approve the soil removal application with the permit valid from May 1, 2016 to May 1, 2017. Seconded by Kilroy. Roll Call Vote: Yes: Barrett, Kilroy, Milton, Worden, Kern and Orr. No: None. Absent: None. Motion Carried.

IV.  Reports

a.  Bill Orr, Watershed.

No report.

b.  Ed Kilroy, Range Road Corridor

No report.

c.  Ed Kilroy, Township Board

Kilroy gave an update on the township board.

V.  Audience Participation

Joseph from 6143 S Branch in The Lakes inquired as to what the township is going to do in regards to the future plans for The Lakes. Erickson advised him that what Kimball Township can and can’t enforce in regards to park.

Discussion on needing a member of the Planning Commission on the ZBA.

Barrett motioned to recommend Bill Orr to the Township Supervisor for placement on the ZBA. Seconded by Worden. Motion Carried.

Milton motioned to adjourn the meeting at 7:10 p.m. Seconded by Barrett. Motion Carried.
