Buyer Agreement

1.  CONCEPT- In an effort to reduce the cost of operating a real estate business, the Broker offers a selection of services and charges a fee for the appropriate services performed. The buyer agrees to help search and locate the property he/she wishes to invest in by performing certain functions and thus a portion of the broker compensation will be credited from the broker to buyer for buyer’s closing costs.

2.  SERVICES PERFORMED BY BUYER – The following services are included but not limited to:

a.  Buyer will locate properties by driving neighborhoods for signs, scanning Internet listings, looking in newspapers and other real estate publications.

b.  Buyer will call their Keller Williams Properties agent and advise on any located property or property of interest and set appointment with the agent to view the properties.

c.  Buyer will visit open houses and call their agent to write any offer on the particular property of interest that was viewed at an open house.

d.  Buyer will drive by all properties on any list obtained from their agent and call to set an appointment with agent to view the properties of interest.

e.  Buyer agrees that all negotiations for the purchase of the property will be conducted through their agent.

f.  Buyer will obtain an approval letter from a local lender prior to making an offer on a property. (Buyer acknowledges that using and out-of-area lender or an Internet lender may compromise the Buyer’s negotiating position.) Lender must allow credits toward purchase or closing cost.

3.  KELLER WILLIAMS PROPERTIES SERVICES PROVIDED BY AGENT

a.  Agent will assist buyer in searching the SEF Multiple Listing Service.

b.  Agent will provide all available information on properties that fit the Buyer’s criteria, providing detailed printouts on the properties.

c.  Agent will provide and/or arrange access to all available properties that interest the buyer.

d.  Agent will prepare the Purchase Agreement and conduct all negotiations between the buyer and the seller or seller’s agent.

e.  Agent will counsel Buyer on all aspects of the offer.

f.  Agent will assist buyer in obtaining financing, professional inspections, disclosure forms, title & escrow through the close of the transaction.

4.  FEES – Keller Williams Properties will be compensated a percentage of commission based on the purchase price of the home and in nearly all cases the fees will be paid by the seller. All parties to the transaction must be informed as per Florida law, which includes the lender. Lender must allow rebates. Keller Williams Properties will credit the buyer based upon the following:

a.  Keller Williams Properties must receive a minimum commission of 2.5% of the purchase price.

b.  From a $500,000 and up purchase price a credit of $2,000 will be applied toward Buyer’s closing costs.

c.  From $350,000 to $499,000 a credit of $1,500 will be applied toward Buyer’s closing costs.

d.  Any property from $200,000 to $349,999 the credit will be $1,000

e.  Any property purchased under $200,000 or listed by Keller Williams Properties, the credit will be $500.

f.  Mobile homes are exempt from any credit

g.  If Agent’s commission is less than 2.5%, the credit will be a flat fee of $1,000 except #e above.

h.  Keller Williams Properties processing fee to buyer of $195.00 will be waived on properties from the MLS only. Processing fee is collected on all flat fee listings.

i.  All rebates will be credited at closing and disclosed to all parties of the transaction.

j.  In order to obtain any credit, the services of the signing Keller Williams Properties agent must be utilized and escrow must be closed with the aid of said agent.

k.  Buyer agrees that any property found from list or e-mails provided by agent from the MLS will be handled by agent. Agent will be entitled to any commissions offered in the MLS. Agent will also be entitled to By-Owner commissions offered.

5.) This agreement cannot be combined with any other offers or promotions.

This agreement will begin on the date of Buyer’s and Agent signing and will terminate at midnight 6 months from executed date.
