RULES & REGULATIONS OF BAYWOOD VILLAGE I

THESE RULES SUPERSEDE ALL OTHER RULES PREVIOUSLY SET

BY BOARD OF DIRECTORS

1) PETS:

A) Dogs are limited to one per household and must weigh 25 pounds or less.

B) Cats and other small indoor house pets are permitted.

C) All owners and residents are subject to the following rules relating to pets:

·  Owners must keep their pets leashed and attended when outside of the condominium unit.

·  Each owner must promptly remove and dispose of all waste matter deposited by their pet.

·  No pet shall be allowed to constitute a nuisance and shall, at all times, be under the control of its owner. Any animal disturbing the peace shall be required to be removed from the condominium property.

·  Pet dogs must be walked on Carambola Circle, not in the property.

·  No animal may be kept, bred or maintained for any commercial purpose.

2) VEHICLES:

A)  No vehicles, other than passenger automobiles, mini-vans and sport utility vehicles, shall be parked or maintained on the premises, as more specifically set forth herein:

·  AUTOMOBILE PARKING SPACES SHALL BE USED SOLELY AND EXCLUSIVELY FOR THAT PURPOSE. For purposes of this rule, “automobile” does not include any type of pick-up truck with an open-bed, commercial vehicle, enclosed van with no windows or seating, bus, camper, motor home, R.V., motorcycle, motor scooter, moped, off-road vehicle, trailer, boat.

·  No commercial vehicles shall be permitted to park within the condominium property except for the purpose of making deliveries or providing service to a unit or the condominium property.

·  No vehicle which cannot operate on its own power will remain on the premises for more than twenty four (24) hours.

·  No Pods or other moving trucks shall be permitted to remain on the premises overnight without prior approval.

B)  All vehicles must park head in. NO backing into a spot or the VEHICLE WILL BE TOWED AT THE OWNER’S EXPENSE.

C)  No vehicle may park on the grass or be doubled parked or THE VEHICLE WILL BE TOWED AT THE OWNER’S EXPENSE.

D)  Vehicles without or expired tags will be TOWED AT THE OWNER’S EXPENSE.

E)  Any vehicle parked on property after 11PM without proper permit parking identification will be towed AT THE OWNER’S EXPENSE. (Resident parking permit & guest permit). Guest parking permits are only valid for 7 consecutive days. If the pass continues on the same vehicle after the seven day period, the vehicle will be tagged and towed if the warning is ignored.

F)  Vehicles will not be repaired or serviced on the property except in emergencies.

G)  Vehicles may not display signs or advertisements of any sort.

H)  The washing of vehicles on property is not permitted. Anyone seen washing vehicles on property will be fined by the association.

*** SUV VEHICLES PERMITTED:

THE TRUCK MUST BE 4 DOOR, SHORT BED AND MANUFACTURERS HARD COVER WHICH MUST BE CLOSED AT ALL TIMES WHEN PARKED IN THE TOWNSHIP. THERE ARE SEVERAL MODELS THAT ARE PERMITTED. SUBMIT REQUEST TO MANAGEMENT PRIOR TO LEAVING VEHICLE ON PROPERTY OVERNIGHT.

ANY VEHICLES IN VIOLATION OF ANY OF THE FOREGOING RULES WILL BE TOWED AT THE OWNER’S EXPENSE.

3) LEASING/RENTAL OF UNITS: A lease is required and subject to approval. No lease shall be for a period of less than one year. Tenants/lessees shall consist of no more than two persons per bedroom in the unit. Subleases are prohibited. Contact management for approval application.

4) POOL:

A)  The pool is open from DAWN TO DUSK each day.

B)  No diving, no running, no bicycles, no skateboards, no pets and no glass containers are permitted in pool or on pool patio. Boogie boards and large floats are not permitted in pool. Small infant floats, noodles, water wings or other small flotation devices are permitted. Children who are not trained MUST wear waterproof pants.

C)  Parents must supervise their children at all times and no child under 16 years of age is allowed in the pool without an adult. Any damage to pool equipment or furniture by children will be the responsibility of the parents.

D)  At no time, should any adult, minor or child, play with or utilize the lifesaving equipment located in the pool area. This equipment is for emergency purposes only.

E)  Parties may only be held at the pool after approval the Board of Directors.

F)  Additional rules and regulations concerning use of the pool shall be posted. Each owner, tenant and/or guest shall observe all Rules and Regulations relating to the use of the pool area.

5) BEAUTY AND SAFETY PURPOSES:

A)  In order to enhance the beauty of our village and for safety purposes, the sidewalks, entrances, passages and stairways and all of the common elements must not be obstructed or encumbered or used for any purpose other than ingress and egress to and from the premises; nor shall any carts, carriages, toys, grilling devices, chairs, tables, bicycles or any other objects be stored therein.

B)  Owners shall store their personal property within their respective units and their designated storage rooms. All balconies and patios must be kept clean, neat and presentable and not used for the storage of unsightly items. There shall be no rugs, mops, trash cans, or other articles left outside the unit or in the landings. The common elements shall be kept free and clear of rubbish, debris and any unsightly material. No owner shall shake or hang a rug or curtain from any part of the common elements or balconies. Clothes lines are not permitted on common property.

C)  Satellite dishes may not be installed on any common element area, including, without limitation, the roof, exterior building / walls, fence, etc. Satellite dishes shall be no larger than one meter (39 inches in diameter) and may only be installed within a condominium unit or within the limited common element patio or balcony appurtenant to such condominium unit, which may be sometimes referred to as the "exclusive use area" for such respective unit. Any Resident or Owner desiring to install a satellite dish must comply with the conditions provided in these Rules. Any owner in violation shall be required to remove the satellite dish at owner’s expense.

D)  In order that all owners may have quiet enjoyment of their property, no Owner shall make or permit any disturbing noises on the Condominium Property by himself, his family, guests or pets. No owner shall unreasonably play or suffer to be played upon, any radio, television, musical instrument, sound amplifier etc. in a manner to disturb or annoy other owners.

E)  During hurricane season, all Residents are directed to remove from their terrace, patio or balcony any and all furnishings that can cause damage to the unit, common property or other units.

F)  Fire, cooking devices or other devices which emit smoke or dust are NOT ALLOWED ON A BALCONY, PATIO OR PORCH. Grilling IS NOT ALLOWED INSIDE, patio, balcony or porch areas of the condominium units.

G)  In order that the buildings maintain an attractive and uniform appearance, no owner shall affix, attach or hang anything to the exterior walls, patio, porch WITHOUT WRITTEN PERMISSION FROM THE BOARD OF DIRECTORS. No fences can be erected upon the property. All requests MUST be placed in writing by using an architectural review form (ARC) provide by management. The Board of Directors will either approve or disapprove your request in writing. If the Board of Directors approves it in writing, the master association, (TCMA) can either approve or disapprove the request in writing. Any alteration of this rule will result in the removal of the item at the owner’s expense. Verbal permission is NOT considered approval.

H)  In order to maintain an attractive appearance, no sign, advertisement, notice or other lettering shall be exhibited, displayed, inscribed, painted or affixed, in, or upon any part of the condominium property without the prior consent of the Board of Directors, except signs used by the Association, for any/all Association business.

I)  Any resident that wishes to make a change or add to the exterior portion of the property that may consist in being common area must receive written authorization from management on behalf of the Board of Directors.

J)  No trees are permitted to be planted by a resident, without the prior approval of the Board of Directors.

K)  Swimming in the lakes is strictly prohibited in all areas of the township.

L)  No one other than persons authorized by the Board of Directors shall be permitted at any time on the roof of the condominium buildings.

M)  Owners shall take all precautions to prevent water leaks from originating from their Units including, but not limited to, proper caulking of bathrooms and kitchen fixtures, proper maintenance and operation of dishwashers, washing machines, hot water heaters, air conditioning units, toilets, etc. When any unit is expected to be vacant or unoccupied for a period of seven (7) consecutive days or more, the owner shall turn off the main water supply to their unit.

6) FLOORING: Unless expressly permitted in writing by the Association, the installation of any floor covering, other than padded carpeting is prohibited in second floor units over other units. In any event, all unit owners shall have the duty of causing there to be placed between any such covering and the floor of the unit generally accepted and approved material for diminution of noise and sound so that the floors shall be adequately sound proofed according to general architectural and engineering standards.

7) SOLICITATION: There shall be no solicitation by any person anywhere on the property for any cause, charity or purpose whatsoever, unless specifically authorized by the Board of Directors.

8) PERSONNEL: Owners or residents may not direct, supervise or assert control over employees or agents of the association for any reason whatsoever.

9) PROPERTY PROTECTION/HURRICANE PREPAREDNESS: Each owner or resident who plans to be absent from his/her unit during HURRICANE SEASON, MUST PREPARE THE UNIT PRIOR TO DEPARTURE BY:

A)  Removing all furniture, plants and other objects from his/her porch, terrace or balcony.

B)  Designate a responsible person, firm or individual to care for your unit should damage occur and furnish the board and management with the names of these individuals should repairs be necessary.

C)  Hurricane shutters are permitted to be installed subject to the association’s approval, and must conform with TCMA and the City of Coconut Creek requirements. Application forms should be obtained from management.

10) EMERGENCIES: In case of an emergency originating in, or threatening any unit, the board or any other person authorized by it, shall have the immediate right to enter such unit for the purpose of remedying or abating the cause of such emergency, notwithstanding that the owner or resident of such unit is present at the time of such emergency.

These rules and regulations shall be cumulative with the covenants, conditions and restrictions set forth in the Declarations of Condominium of Baywood Village I.
