On the __ day of ______, 20____ you were served with a 3 Day Notice to Pay or Quit requiring you to pay your past due rent (and past due fees and charges, if applicable). As a result of your failure to pay in a timely fashion, your tenancy has been terminated. Your payment does not resolve the breach and LANDLORD intends to pursue and/or continue with the lawsuit to eject and remove you from the PREMISES.

RESERVATION OF RIGHTS: Your payment will be deposited, and all funds received above will be applied to your outstanding balance. Acceptance of the rent payment (and past due fees and charges, if applicable) is with reservation of all rights and remedies available to LANDLORD pursuant to K.S.A. 58-2566, and does not constitute a waiver of any rights. Thus this acceptance of rent (and past due fees and charges, if applicable) with reservation of rights does not constitute a renewal of the rental agreement, nor does it create a new rental agreement.
