Intellectual Property Assignment Agreement For Staff And Students

As an employee/student of TexasState, I understand that:

  1. Work done using university resources and/or space is the property of TexasState. This may include but is not limited to intellectual property including inventions whether or not they are patentable, copyright, mask works, know-how, trademarks, and research instruments.
  2. I have an obligation to keep theUniversity informed. I will promptly disclose to the University fully and in writing all University Inventions or other University intellectual property. This disclosure shall be filed with the appropriate representative in the Office of Commercializationand Industrial Relations (OCIR).
  1. In addition, during the first year after termination of my Service, I will provide the University with a complete copy of each patent application and copyright registration application (including but not limited to any mask work registration application) filed by me or that names me as an inventor, co-inventor, author, co-author, creator, co-creator, developer, or co-developer.
  1. I may have obligations to previous employers or business partners. To preclude any possible uncertainty over the ownership of any Inventions or other intellectual property, I have made a list of all Inventions or other intellectual property that I have developed, alone or jointly with others , that I consider to be my property or the property of third parties (collectively, “Retained Inventions”). If any Retained Invention or retained other intellectual property is used to develop University intellectual property, I will promptly disclose this information to the appropriate representative in the OCIR.
  1. I may not engage in activities with any entity that may conflict with my employment/educational obligations at TexasState. I will follow University policy regarding outside employment. I will at no time receive compensation from both the University and a third party simultaneously for work related to sponsored projects including contracts, grants, and consulting.
