Information note Concerning the Processing of Personal Data

In accordance with and in consequence of Italian Legislative Decree 30 June 2003, no.196 (Legislation on personal data protection), and likewise for the regulations of Directive 95/46/EC, we wish to inform you that the personal data you have voluntarily made available to Ferrari S.p.A. (hereafter referred to as “the Company”), also via the dealers and/or other subjects who form the Company's Sales and Service Network, will be treated in compliance with the current provisions relating to personal data protection and the principles of confidentiality on which the Company's activities are founded.

1. Purposes of the data processing

Your personal data will be used: (a) to process and execute your purchase orders and service requests; (b) in order to allow you to make use of the aftersales and warranty services offered by Ferrari S.p.A., also through its Sales and Service Network; (c) to respond to any queries you may have and for communications of a technical/organisational nature; (d) to carry out analyses, statistical and/or market research and surveys; (e) to organise and hold events and exhibitions, also of a promotional nature; (f) to allow Ferrari S.p.A. to send you information and promotional communications, also of a commercial nature, as well as advertising material and/or offers for goods and services by mail, fax, Internet, telephone, e-mail, MMS, SMS from Italy or abroad (also from non-EC countries). The above may also be sent by the Sales and Service Network, by individuals or legal bodies that collaborate with Ferrari S.p.A. and/or by parent companies, subsidiaries and/or related companies.

2. Categories of processed data

In relation to the above-indicated purposes, the following categories of personal data may be gathered and processed (excluding sensitive and/or judicial data): personal data (name, surname, date and place of birth, sex, nationality); contact information (address, telephone, fax, e-mail); title; occupation/profession; languages spoken; identification data of the company owning the vehicle (company name, headquarters, nationality, telephone, fax, e-mail address); method of payment (cash, financing, etc.); order date; warranty start date; vehicle registration number and chassis number.

3. Data processing methods

Your personal data will be processed using suitable paper, electronic and/or telematic means, according to fair business practices strictly related to the purposes set out above and, in any event, so as to guarantee the protection and confidentiality of your personal data.

4. Providing personal data and consequences in the event of refusal

Providing your personal data is voluntary; nonetheless, should you refuse to provide this data and/or provide inexact or incomplete information, this might have the following consequences: the impossibility to execute your orders; the impossibility to provide you with the services offered by the Company, including aftersales and warranty services; non-compliance of the results obtained from the processing of your personal data with the obligations provided for by applicable legislation, including tax legislation, as well as the impossibility for the Company to fulfil the said obligations; the impossibility for the Company to perform all those activities (including the sending of information and promotional communications and/or advertising material) which require the processing of your personal data.

5. Data disclosure

Within the Company, the following persons may have access to your personal data: shareholders, the members of the Board of Directors or another administrative body, the members of the Board of Statutory Auditors, the auditors, Company personnel, in particular those of Sales and Brand Management (Sales, Marketing and CRM departments, the Technical Service Department, Market Analysis and Research), Administration Management, the Information Systems body and, in any case, the Head and employees handling personal data processing, as designated by Ferrari S.p.A., during the execution of their work. Your personal data may be communicated to qualified persons who provide Ferrari S.p.A. with work or services instrumental for the purposes indicated in paragraph 1 above, including the persons and companies that manage and/or participate in the management and/or maintenance of our Internet sites and the electronic and/or telematic tools we use.

Again in the pursuit of the purposes indicated in paragraph 1 above, your personal data may also be communicated to the following categories of person, who may gain access to your personal data: parent companies, subsidiaries and/or affiliates; dealers, importers and other persons that form the Ferrari Sales and Service Network in Italy and abroad; persons, bodies and/or companies that provide work or services instrumental for the management of your orders and the provision of services requested (including aftersales and warranty services), processing of statistical and market research, organisation of events and exhibitions, sending of information and/or commercial communications. These persons include, by way of example, banks, insurance companies, suppliers, contractors and subcontractors; experts who assist the Company in various ways, in particular in relation to the legal, tax, social security, accounting and organisational aspects; any other person to whom your personal data must be disclosed in accordance with an express legal provision.

Your personal data may be transferred abroad, in accordance with applicable legislation, also to non-EC countries where the Company works in its own interest.

6. Data dissemination

Your personal data will not be subject to dissemination.

7. Rights of the individual concerned

Regarding the above-mentioned data processing, you may exercise the rights provided for in Art. 7 of Leg. Decree 196 of 30 June 2003, the full text of which is copied in full below, for your convenience:

Art. 7 - Right of access to personal data and other rights

1.The individual concerned has the right to obtain confirmation of the existence or non-existence of personal data concerning him/her, even if it is not yet recorded, and its disclosure in an understandable form.

2.The individual concerned has the right to obtain information about: a) the origin of the personal data; b) the purpose and methods of the data processing; c) the methods and criteria applied in the event of data processing using electronic instruments; d) identification details of the holder, the persons in charge and the representative, appointed in accordance with article 5, paragraph 2; e) subjects or categories of subjects to whom personal data may be disclosed or who may become aware of such information in their capacity as appointed representative in the territory of the state, as persons in charge or persons appointed for this purpose.

3.The individual concerned has the right to obtain: a) the updating, the correction or, when of interest, the integration of personal data; b) the cancellation, transformation in an anonymous form or the blocking of data processed by breach of the law, including any data whose preservation is not necessary in relation with the purposes for which it has been collected or processed at a later date; c) the certificate attesting that the operations provided for under letters a) and b) have been made known, including their contents, to the persons whom the data was disclosed or disseminated, except in the event that such fulfilment is impossible or involves the use of means that are clearly non-proportional with respect to the protected right.

4.The individual concerned has the right to oppose, in all or part: a) for legitimate reasons, the processing of his/her personal data, even if it concerns the purpose of its collection; b) the processing of his/her personal data for the purpose of sending advertising or direct sales materials or for carrying out market or sales communication surveys.

8. Holder and person in charge of the data processing

The holder of the data processing is Ferrari S.p.A., with registered office in Modena, Via Emilia Est, no.1163. The person in charge of the processing of your personal data on behalf of the Company is the Head of Granturismo Human Resources, domiciled, within the scope of his office, at the Company headquarters, Via Abetone Inferiore 4, Maranello (MO). 9. Consent

I have read the above information and consent to the processing of my personal data as indicated above, including the communication to persons mentioned and/or the transfer abroad, for the execution and processing of analyses, statistical and/or market research and surveys, for the organisation and holding of events and exhibitions, also of a promotional nature, as well as for the sending of information and/or promotional communications, also of a commercial nature, advertising material and/or offers for goods and services by mail, fax, Internet, telephone, e-mail, MMS, SMS from Italy or abroad (also from non-EC countries) by Ferrari S.p.A., its Sales and Service Network, individuals or legal bodies that collaborate with Ferrari S.p.A., and/or by parent companies, subsidiaries and/or related companies.
