Affidavit of Fact
To Whom It May Concern:
I’m writing to tell you the harm that was done to me when Geo Vista Credit, and the Statesboro Police Dept. Took my money. I hired a lawyer to represent me in my criminal case.
The attorney told me the fee to represent me would have to be 15,000. I gave him a 10,000.00 deposit to start working on my case.
I had not been indicted yet, and once I was indicted the lawyer told me that now he would have to charge me 30,000.00 for my case which means I would need to give him another 20,000.00.
I want to the Geo Vista Credit Union to and tried to withdraw my money and the clerk told me that my account had been frozen by the Federal Government. Now I find out the government never seized or possessed my money. When I could not pay the additional 20,000.00 to my attorney he refused to appear in court for me. So when I was arraigned in Statesboro, GA, U.S. Attorney David Stewart notified me that my attorney would not be attending court and the judge decided to issue me a court appointed attorney since I did not have any more money.
The attorney the court appointed to me had never tried a federal case before and made a lot of errors. I have brought my ineffective assist. Of counsel against him. His inexperience resulted in 151 month sentence in Federal Prison.
I was told with my plea agreement I would not get more than 7 yrs. In prison. I loss 10,000.00 in attorney fees and I was in the process of buying a house when my account was frozen. I could not finalize the closing because the bank would not allow me to access my account. I posted 1500.00 earnest money for the house which I never got back. I was never served the “process of service” so my money was taken without due process of law.
