COMES NOW, the Plaintiff and for his/her cause of action against the Defendants, alleges and states as follows:

1. The Plaintiff is adult and does hereby subject himself to the jurisdiction of the State of Nebraska and this Court.

2. That the Defendants are adults and are either residents of the State of Nebraska or are owners of real estate in the State of Nebraska and are, therefore, under the jurisdiction of this Court.

3. That the real estate which is the subject of this Petition is described as follows:

4. That the Plaintiff is the owner of an undivided one-fifth interest in the aforedescribed real property.

5. That the Defendant A is the owner of an undivided one-fifth interest in the aforedescribed real property.

6. That the Defendant B is the owner of an undivided one-fifth interest in the aforedescribed real property.

7. That the Defendant C is the owner of an undivided one-fifth interest in the aforedescribed real property.

8. That the Defendant D is the owner of an undivided one-fifth interest in the aforedescribed real property.

9. That the Defendant A is a single person; that the Defendant BB is the wife of Defendant B; that the Defendant CC is the wife of Defendant C; and that the Defendant DD is the wife of Defendant D.

10. That the Defendant BB, CC, and DD have no interest in the subject real estate other than a marital interest that they may allege herein.

11. That the Defendant, Tenant 1, is a tenant in possession of the real property, located in Tract 3, Tract 4 and part of Tract 2.

12. That the Plaintiff currently resides in the house located on the subject real estate described as Tract 5 [OPTIONAL]

13. That the Defendant, Tenant 2, is a tenant in possession of the house and buildings on the real property described in Tract 1.

14. That John Doe and Jane Doe, real names unknown, are the tenants in possession of Tract 1 and Tract 2.

15. That the Defendant, Oil Company 1, may claim an interest to Tract 4 pursuant to an Oil and Gas Lease recorded on [date] in Book ___ at Page ___ of the Miscellaneous Records of the Register of Deeds for ______County, Nebraska. That the Defendant, Oil Company 2 , may claim an interest to Tract 2 pursuant to an Oil and Gas Lease recorded on [date] in Book ___ at Page ___ of the Miscellaneous Records of the Register of Deeds for ______County, Nebraska.

16. That the Plaintiff is entitled to a partition and requests a partition of the aforedescribed property.

17. That it does not appear that the property is susceptible to a division in kind, without material injury to the rights of the parties, and the sale of the property and the division of proceeds among the owners is necessary.

18. That the Plaintiff be awarded attorney’s fees and costs as provided in Neb. Rev. Stat. §25-21,108.

19. That the real property as described herein consists of agricultural land, a house and outbuildings, which must be utilized by lease or otherwise until partition can be had; therefore, the appointment of a receiver is required.

COMES NOW, the Plaintiff and pursuant to Neb. Rev. Stat. §25-1331 through 25-1336 hereby moves the Court to enter summary judgment in favor of the Plaintiff and against the Defendants A, B, BB, C, CC, D and DD as prayed for in the Plaintiff’s Complaint for the reason that there is no genuine issue as to any material fact and said Plaintiffs are entitled to summary judgment as a matter of law. This motion is based upon:
