ORDER OF REFERRAL TO COUNTY COURT MEDIATION

In accordance with the applicable Rules Statutes, and Administrative Orders, this matter is referred to County Court Mediation.

X (a) Parties shall call the office of the Mediator, County Court Mediation

Division, Room 603, Dade County Courthouse, Miami,

Telephone 305/349-7337.

The parties, unless otherwise waived by this Order, are assessed a fee of $120.00 for the first hour, or any part thereof. Such conference shall not exceed one (1) hour, unless the parties mutually agree, and in that case, at $120.00 for each additional hour, or any part thereof, thereafter. All Mediation fees shall be paid: 50% by Plaintiff(s) and 50% by Defendant(s), seven (7) days prior to scheduled Mediation Conference, and balance, if any shall be paid at conclusion of each conference.

The parties may jointly name their own Certified Mediator by filling a written stipulation signed by all parties with the Court, within 10 days of date of this Order.


The Court Orders:

1. All parties are required to participate in mediation within 15 days from the date of this Order.

a. The appearance of counsel who will try the case for each party represented by counsel and representatives of each party with full authority to enter into a complete compromise and settlement is mandatory. If insurance is involved, an adjuster with authority up to the policy limits or the most recent demand, whichever is lower, shall attend.

b. The parties shall mutually agree upon a mediator. If the parties can not agree, counsel for the Plaintiff shall notify the Court within five (5) days from the date of this Order and a mediator will be appointed by the Court.

c. A mediation report shall be provided to the Court setting out the results of the mediation.

2. Completion of mediation is a prerequisite to trial. If mediation is not conducted, or if a party fails to participate in mediation, the case may be stricken from the trial calendar, pleadings may be stricken and other sanctions may be imposed.

3. Any party opposing mediation may proceed under Florida Rule of Civil Procedure 1.700(b).
