IE services for 4 laning of Panikoili-Remuli Section of NH-215 from Km 0.000 Monthly Progress Report

to Km 163.000 in the State of Odisha on DBFOT Basis under NHDP-Phase-III Apr-2017

1.1Summary of the current month’s progress

Physical Progress of the project highway during current month is 2.20% and overall physical progress is 87.50%and financial progress is87.23%.Total expenditure is Rs.1831.54 Crore till 25.04.2017.Concessionaire has completed DBM work for299.426 Kms. (2-lane) and BC work has been done for 282Kms. (2-lane).Further, DBM for four laning has been completed for approximately 150Kms.

Current Issue and recommended action by IE:

  • Issues related to the progress made by concessionaire: As per the opinion of IE, Concessionaire has achieved the milestone -III on 04.07.2016 within the stipulated grace period subject to:-
  • The reasons stated by the Concessionaire for non-commencement of one major bridge, one minor bridge and project facilities as per stated reasons is acceptable to the Authority.

However scheduled completion of 4-laning might be further delayed because of the following reasons:-

  • Construction of Major Bridge at Km 35+803 and one EUP at Km 102+000 has been commenced in the end of Nov 2016.
  • Additional land required for project facilities like toll plaza, way side amenities, truck lay bye, bus bay and missing bits at various places, to the tune of 14.767 Ha.
  • Issues with pending land acquisition, clearances & utility shifting, encumbrances etc.:
  • Almost complete stretch is encumbrance free and available for construction except a few missing bits comprising of a total length of approx. 0.22 Km. (4-lane) It is highlighted that four laning work is not affected because Concessionaire has not exhausted available working fronts.
  • Status of change of scope proposals:
  • The change of scope proposal has been submitted to NHAI vide IE letter No. SAI/IC/02/499/2016 Date: 10thJun 2016 for 16 structures (Slip / Service roads at 09 locations, 05 locations for underpasses, 01 box culvert and 01 double cell VUP).
  • A revised comprehensive proposal for change of scope has been prepared for a total cost of Rs. 25,47,00,000/- and submitted to NHAI vide letter no. SAI/IC/02/655/2017 Dated 22nd March 2017 for approval.
  • There is a reduction in scope of work in terms of quantities – Approaches of structures. The complete proposal of saving amount yet to be submitted by the concessionaire.
  • Concessionaire has constructed a PUP at Km 45+450, whereas a VUP is provisioned at this particular location as per Schedule ‘B’ of CA, accordingly IE has issued a NCR to this effect.
  • Another change of scope proposal has been submitted by concessionaire vide letter no –SMTL/P-R/NH-215/PVR-GM/I.E./2017-15/981 dated 19.04.2017 amounting to Rs. 14,38,98,000/-

Summary of Progress:

The total length of the project is 166.173 Km. from 0+000 to 166+173 (Design length), the total project cost is Rs. 1410 Crore, with VGF of Rs. 548.49 Crore.The concessionaire for the project is M/s. Sai MaaTariniTollways Limited (SMTL) Letter of award was issued on 11 Aug 2011 and date of signing the agreement was 28 Sep 2011. Appointed date for the project is 02 May 2013, construction period is 910 days and concession period is 24 years including construction period. Scheduled completion date was 29 Oct 2015.

Project Milestone – I have been achieved on 26 Jan 2014, Project Milestone – II has been achieved on 30 Sep 2014 and project mile stone-III has been achieved on 04 July 2016 subjected to reasons stated above.

Scheduled completion of 4-laning might be further delayed because of the following reasons:-

  • Construction of Major Bridge at Km 35+803 and one EUP at Km 102+000 has been commenced in the end of Nov 2016.
  • There is a total of 27.276 ha. Additional land required by concessionaire, for which land acquisition process is still in progress.

It is highlighted that the vigilance division, HO, NHAI, had carried out CTE type inspection from 07.11.2016 to 11.11.2016 and has intimated their detailed report vide NHAI letter no-13029/4/2014-Vig dated 22.12.2016. Necessary action is being taken.

1.2.2Obligation as per Contract

Critical Obligations and constraints of Concessionaire as per contract:-

  1. Memorandum containing an inventory of the site including the vacant and unencumbered land, buildings, structures, road works, trees and any other immovable property on or attached to the site, which was communicated vide PIU letter No. 5111 dated 26 Jun 2013, was required to be signed by concessionaire, has not been signed as yet.
  2. As per CA clause 10.3.6, concessionaire was required to provide the details of the additional land required for Toll Plazas, Traffic Aid Posts, Medical Aid Posts, Underpasses and Overpasses, and any additional land for construction of works specified in change of scope order issued under Article 16, within 60 days from the appointed date and has actually given this requirement in Jun 2014 i.e. almost after 1 year from appointed date.
  3. Concessionaire has not submitted the revised work programme.
  4. Safety precautions taken by concessionaire are inadequate.
  5. Concessionaire has not exhausted completely, the working fronts available.
  6. It is pointed out that concessionaire has not ensured that the design & drawings / plan & profile of the specific structure / road work are concurred by IE before commencement of the work. Further, it is also emphasized that more than three (3) years have been lapsed, but still there are certain compliance on the submitted design & drawings / plan & profile of the various structures / road works, which are yet to be complied by the concessionaire.
  7. There are a total of 57 NCRs which has been raised till date, out of which only 27 are closed balance are 30 are still open. The detail of NCR is attached in Annexure-II.

Critical Obligations of Authority as per contract:-

  1. Delay in diversion of the forest land of 151.94 ha involving a total length of 23.6 Kms. out of a total stretch of 166.173 Kms. (14.20%).
  2. Delay in giving full possession of non-forest land, removal of govt. and private buildings from PROW and acquisition of additional land for project facilities.
  3. Belbahali Issue: Concessionaire was not able to commence the construction of new Belbahali Bridge at Ch. 35+431, span 15 X 23.312 mtrs. AsperCA, villagers have represented the case in the Hon’ble High Court, Cuttack, Odisha. Recently in August 2016, the case has been dismissed by the Hon’ble Court and the decision has been given that the bridge to be constructed as per the provision of CA and recommendations given by IIT, Kharagpur. Now concessionaire has commenced the construction of this bridge.
  4. Almost complete stretch is encumbrance free and available for construction except a few missing bits comprising of a total length of approx. 0.448 kms.((2-lane) (copy enclosed at Annexure-III)) It is highlighted that four laning work progress is not hampered because numbers of working fronts are still available.

1.7Change of Scope

  • There is a reduction in scope of work in terms of quantities – Approaches of structures. The complete proposal of saving amount yet to be submitted by the concessionaire.
