SUNDAY CLOSING BILLS DEAD FOR THIS YEAR


Two weeks ago, the Senate Transportation Committee sent all three Sunday Closing Repeal bills to a Senate Sub-Committee, essentially killing these pieces of legislation for the remainder of this legislative session.
Senator Oberweis had introduced three (3) bills which amend the provision in the Vehicle Code that prohibits the sale of motor vehicles on Sunday. These bills do the following:

·  SB 1706 allows for the sale of vehicles by dealers on Sundays if the dealer is a person who observes a religious day of worship other than Sunday.

·  SB 1780 repeals the current Sunday Closing Law and allows dealerships to operate and sell vehicles on Sunday.

·  SB 1835 allows for the sale of motor vehicles by dealers for no more than 2 hours on Sunday.

The Senate Transportation Committee heard 1 ½ hours of testimony from proponents/opponents regarding this issue. Senator Oberweis, the Illinois Policy Institute and a University of Illinois Consumer Advocate Professor testified in favor of repealing the current Sunday Closing law.
Special thanks to franchised dealers Desmond Roberts, Advantage Chevrolet and Colin Wickstrom, Wickstrom Chrysler-Dodge-Ford/Lincoln for their expert testimony in the industry opposition to the Sunday Closing repeal. These gentlemen did a great job testifying and providing the dealer point of view in keeping dealerships closed on Sundays--- -their input was crucial in defeating these bills for this year.
It appears Senator Oberweis will continue his efforts regarding a repeal of this legislation. He has made numerous attempts the past two legislative sessions and we expect him to continue his crusade next session.
IADA would like to thank dealers and their employees for their calls, e-mails and notes to their state senators on these bills. Your continued support has kept dealerships closed on Sundays.
Please make every effort when visiting with your local legislators to emphasize how important maintaining the Sunday Closing Law is to our industry!

NEW REVENUE PROPOSALS BEING FLOATED

With Illinois' mounting budget problems, lawmakers/administrators are always looking for ways to raise additional revenues to pay the backlog of bills that the State of Illinois owes. As of last week, Illinois is roughly $6-$9 billion behind in paying the bills they owe businesses and vendors.

With the May 31st adjournment date fast approaching, the final days of session are extremely hectic with numerous proposals that directly affect franchised dealers. IADA has identified two possible revenue items which dealers should take note.

**SERVICE TAX ON ADVERTISING

Early in his campaign, Governor Rauner proposed extending sales tax on a number of services, including advertising on bill boards, radio and television ads as well as ad agency services.

Since the Governor has not made his service tax proposals official, it is speculated that it will include advertising. It has been relayed to IADA that the tax could be as high as 10% on these services.

**SERVICE TAX TO INCLUDE AUTO REPAIRS/LABOR

Another service tax extension that Governor Rauner proposed would include labor on all auto service repairs. Currently, tax is only due on parts. This proposal would also include labor.

ELIMINATION OF DEALERS 1¾% RETAILERS COLLECTION ALLOWANCE

Again, due to budget problems, there have been considerable discussions of elimination of the Retailer’s Collection Allowance. Currently, Illinois dealers/businesses are allowed to keep 1.75% of the sales tax collected as reimbursement for serving as the state’s tax collector and remitter.

Eliminating the dealers collection allowance is always a possibility during budget negotiations in the final days of session.

As dealers realize, the allowance only partially reimburses retailers for their on-going costs and liability for serving as the state’s tax collector.
