Please read this Waiver and Release carefully. If you have any questions, please be sure to contact an attorney.

1.The Event: I understand that my student will be attending NESCom Alive, sponsored by the New England School of Communications at Husson University during the days of May 14 and 15, 2018(“the Event”). The Event will be held on the premises of Husson University, One College Circle, Bangor, Maine.

2. Food Allergies: I understand that my student will have the option to and may actually consume food prepared by employees of Husson University and other food that is available throughout the College from vending machines, cafes, bookstores and other locations, as well as from other campers and counselors. I understand that my student may be exposed to substances, including but not limited to, peanuts, dairy or wheat or their by-products whether in food or airborne that may sometimes cause allergic or other reactions. Though special dietary requests have been or may have been requested, and though Husson University through its employees may make reasonable efforts to accommodate that request, Husson University, its officers, trustees, employees, volunteers, agents or representatives, (collectively referred to herein as “University Staff.”) disclaim any and all liability for exposure to such risks.

3.Waiver of Liability / Indemnification: In consideration for my student’s participation in the Event, I agree on behalf of myself, my student’s other parent if known or living, my student named herein, and our heirs, successors and assigns (“Our Behalf”), that we assume all risks resulting from or arising out of the Event including but not limited to transportation to and from the Event and overnight boarding in Husson facilities (if applicable), and therefore I release from liability and waive any liability of any nature whatsoever against and agree to indemnify, defend and hold harmless Husson University and its employees, students and trustees from any and all actions, claims and demands that may be made or brought on Our Behalf against Husson University and/or its students, employees and trustees arising out of or in connection with my student’s attendance at the Event . By signing this Waiver, Release and Permission, I agree and acknowledge that I may be giving up important legal rights and remedies available to myself, my student, my family, my heirs and assigns.

4. Permission to Use Material: I, on my behalf and on behalf of my student, hereby grant to Husson University, its designees and successors (collectively referred to as the “Producers”):

A. The right to record and use the physical appearance, image, likeness, voice, features, performance, name, biographical information, and achievements, with or without my student’s name, in any media and any media format including but not limited to digital, analog, print, and film as well as the right to record and use any performance or media created by my student at or related to the Event. (collectively referred to as the “Material”). The right to record and use the Material shall include but not be limited to the right to copyright, reproduce, duplicate and transfer.

B. The right to record and use the Material includes but is not limited to the right to use, exhibit, broadcast or distribute the Material in whole or in part by or on behalf of the Producers for any commercial, educational or promotional purpose without restrictions or limitations and at the sole discretion of the Producers. The Material may be used, exhibited, broadcasted or distributed by or on behalf of the Producers in any media for any purpose including but not limited to websites; internet; social media; email, television, radio and cable broadcast; print and electronic newspapers, presentations, displays, magazines, newsletters and promotional materials and advertisements and,

C. I waive any right I may have to inspect or approve any finished recording or product of the Material.

5.Severability: Should any part or portion of this Waiver, Release and Permission be found unenforceable, the parties agree that the remaining terms of this Waiver, Permission and Release should be enforceable to the fullest extent to protect the University and its students, employees and trustees from liability.
