THIS INDENTURE,made the[DATE] day of [MONTH], in the year Two Thousand [YEAR, IN WORDS] ([YEAR, IN NUMBERS]),

BETWEEN[CLIENT]

(hereinafter called the Grantors of the one part), and

[CLIENT]

(hereinafter called the Grantee of the other part)

WITNESSETH: That the said Grantors have granted, bargained and sold, released, and confirmed, and by these presents do grant, bargain and sell, release, and confirm unto the said Grantee, [HIS/HER] heirs and assigns,

ALL THAT CERTAIN lot or piece of ground with the buildings and improvements thereon erected,

SITUATE on the [LEGAL PROPERTY DESCRIPTION],

CONTAINING in front or breadth [LEGAL PROPERTY DESCRIPTION],

BEING known as Premises No.[STREET ADDRESS OF PROPERTY],

BEING the same premises that [GRANTOR WHO TRANSFERRED PROPERTY TO DECEASED RECORD OWNER], by Deed dated [DATE] and recorded at Philadelphia, Pennsylvania, [[in Deed Book [DEED BOOK NAME] No. [DEED BOOK NUMBER], at page [DEED BOOK PAGE NUMBER]] OR as Document Number [DOCUMENT ID NUMBER]], granted and conveyed to [DECEASED RECORD OWNER], in fee,

WHEREAS [DECEASED RECORD OWNER] died [TESTATE/INTESTATE] on [DATE OF DEATH], leaving as [HIS/HER] heirs [HIS/HER][CHILDREN/GRANDCHILDREN/

SIBLINGS/ETC.], [NAMES OF CHILDREN/GRANDCHILDREN/SIBLINGS/ETC. WHO ARE THE DECEASED RECORD OWNER’S HEIRS],

AND WHEREAS [CLIENT] filed a § 3546 Petition for Determination of Title to Real Estate in the Orphans’ Court Division of the Court of Common Pleas of Philadelphia, as O.C. No. [NUMBER] DE of [YEAR], Control No. [NUMBER], asking the court to adjudge that title to [DECEASED RECORD OWNER]’s interest in the real estate located at [PROPERTY ADDRESS] is in the name of [CLIENT], and directing the Commissioner of the Department of Records of Philadelphia County to record a Deed of Confirmation that reflects [CLIENT]’s sole ownership of [PROPERTY ADDRESS],

AND WHEREAS The Honorable [JUDGE’S FULL NAME] of the Orphans’ Court Division of the Court of Common Pleas of Philadelphia issued a Decree Nisi dated [DATE OF DECREE NISI], ordering and decreeing that title to the interest of [DECEASED RECORD OWNER] in the real property located at [PROPERTY ADDRESS] is adjudged in [CLIENT]; that notice of said Decree shall be given by mail, by advertisement, and by posting on the premises of [PROPERTY ADDRESS]; that proof of service and advertisement shall be filed of record; and that if no exception to said Decree is filed within three (3) months, it shall be confirmed absolutely,

AND WHEREAS[CLIENT] sent notice of said Decree by mail, by advertisement, and by posting on the premises of [PROPERTY ADDRESS], and filed a proof of service and advertisement with the Clerk of the Orphans’ Court Division,

AND WHEREAS no exceptions to said Decree were filed within three (3) months of said notice by mail, by advertisement, and by posting on the premises of [PROPERTY ADDRESS],

AND WHEREAS ownership of said premises was then vested in [CLIENT], as evidenced by the certified copy of said Decree that is attached hereto as Exhibit a, and the purpose of this Deed of Confirmation being to confirm ownership of said premises in [CLIENT], in accordance with the above-referenced Decree,

TOGETHER with all and singular the buildings, improvements, ways, streets, alleys, driveways, passages, waters, water-courses, rights, liberties, privileges, hereditaments and appurtenances, whatsoever unto the hereby granted premises belonging, or in any way appertaining, and the reversions and remainders, rents, issues, and profits thereof; and all the estate, right, title, interest, property, claim and demand whatsoever of them, the said Grantor, as well at law as in equity, of, in and to the same.

TO HAVE AND TO HOLD the said lot or piece of ground described with the buildings and improvements thereon erected, hereditaments and premises hereby granted, or mentioned and intended so to be, with the appurtenances, unto the said Grantee, [HIS/HER] heirs and assigns, to and for the only proper use and behoof of the said Grantee,[HIS/HER] heirs and assigns forever.

AND the said Grantor, for [HIS/HER]self, heirs, executors and administrators do covenant, promise and agree, to and with the said Grantee, [HIS/HER] heirs and assigns, by these presents, that they, the said Grantor and [HIS/HER] heirs, all and singular the hereditaments and premises hereby granted or mentioned and intended so to be, with the appurtenances, unto the said Grantee, [HIS/HER] heirs and assigns, against them, the said Grantor and [HIS/HER] heirs, and against all and every person and persons whomsoever lawfully claiming or to claim the same or any part thereof, by from or under him, her, them, or any of them, shall and will SUBJECT as aforesaid, WARRANT and forever DEFEND.
