The Parliament of Victoriaenacts:

Health (Fluoridation) Amendment Bill 2007

1Purpose

The purpose of this Act is to prevent the addition of fluoride to a public water supply unless a poll of voters in each municipal district, or in each ward of each municipal district, within the relevant water supply district has first approved the addition of fluoride to the water supply.

2Commencement

This Act comes into operation on the day after the day on which it receives the Royal Assent.

3Amendment of section 5(1) of the Health (Fluoridation) Act 1973

In section 5(1) of the Health (Fluoridation) Act 1973, for "A water supply authority" substitute "Subject to section 5A, a water supply authority".

4New section 5A inserted in the Health (Fluoridation) Act 1973

After section 5 of the Health (Fluoridation) Act 1973 insert

"5A Fluoride not to be added unless approved by a poll of voters

(1)A water supply authority must not, either on its own initiative or when required by the Secretary, add fluoride to any public water supply under its control unless—

(a)the Council of each municipal district in which the district of the water supply authority, or any part of that district, is situated, has caused to be held (in accordance with the provisions of the Local Government Act 1989, except that clause 16 of Schedule 3 to that Act does not apply) a poll of voters—

(i)if the municipal district is not subdivided into wards, in that municipal district; or

(ii)if the municipal district is subdivided into wards, in each ward of the municipal district in which any part of the district of the water supply authority is situated—

to obtain the opinion of voters in the municipal district or ward on whether fluoride should be added to the public water supply; and

(b)if any part of the district of the water supply authority is situated in more than one municipal district, all the polls under paragraph (a) are held on the same day; and

(c)the result of the poll, or polls, as the case requires, is that a majority of those who voted are of the opinion that fluoride should be added to the public water supply.

(2)Nothing in this section applies to the addition of fluoride to a public water supply that, immediately before the commencement of the Health (Fluoridation) Amendment Act 2007, contained fluoride that had lawfully been added in accordance with this Act.".

5Repeal of Act

s. 5

This Act is repealed on the first anniversary of its commencement.
