Under the powers delegated to me by the Governance Committee on 30 January 2003, Ihave issued a Written Notice dated 4 May 2017 authorising the carrying out of the above development pursuant to Regulation 3 of the Town and Country Planning General Regulations 1992. Planning Permission is now granted. A copy of the Written Notice is attached hereto.

Therefore, in accordance with Regulation 3 would you please accept this letter in conjunction with the plans shown as formal notification of the development for the purpose of your Register of Planning Applications and Decisions.

TAKE NOTICE that under the powers delegated to me by the Governance Committee meeting held on 30 January 2003 I have authorised the development described in Schedule 1 hereto, pursuant to Regulation 3 of the Town and Country Planning General Regulations 1992, subject to the conditions set out in Schedule 2 hereto.

SCHEDULE 1

Minor material amendment to planning permission HS/3318/CC (granted 22 September 2016) to vary Condition 2 to expand the scope of works to include new lamp standards and fittings. SCHEDULE 2

1. The development hereby permitted shall be commenced before 22 September 2019.

Reason: To comply with Section 91 of the Town and Country Planning Act 1990.

2. The development hereby permitted shall be carried out in accordance with the plans listed in the Schedule of Approved Plans.

Reason: For the avoidance of doubt and in the interests of proper planning.

3. Unless otherwise agreed in writing by the Director of Communities, Economy and Transport the external lighting, hereby permitted, shall not be used other than between the hours of 07.00 and 09.00 and 16.30 and 21.00 Monday to Friday inclusive and at no time on Bank or Public holidays. The external lighting shall not be used outside of these times expect for works of essential maintenance or to respond to an emergency. No later than two working days after the operation of the lights outside of the permitted hours details of the time, date and reason for and nature of the maintenance required or emergency shall be given in writing to the Director of Communities, Economy and Transport.

Reason: To help safeguard the amenities of the occupiers of residential properties in the vicinity of the site in accordance with Policies DM3 and HC3 of the Hastings Development Management Plan.

4. The external lighting, hereby permitted, shall be fitted with a light cell control which will switch off the lights when not required during daylight hours.

Reason: To help protect residential amenity and comply with Policies DM3 and HC3 of the Hastings Development Management Plan 2015.

5. In the event of a power cut the default position of the control panel for the external lighting at the School shall be set to 'OFF'.

Reason: To help protect residential amenity and comply with Policies DM3 and HC3 of the Hastings Development Management Plan 2015.

6. Unless otherwise agreed in writing by the Director of Communities, Economy and Transport the three lamp standards, hereby permitted, shall be fitted with Auriga Spill Shields which shall be installed within one month of the date of this permission in accordance with the approved details and written confirmation of the installation shall be provided to the Director of Communities, Economy and Transport. The lamp standards and spill shields shall be retained as such thereafter.

Reason: To help safeguard the amenities of the occupiers of residential properties in the vicinity of the site in accordance with Policies DM3 and HC3 of the Hastings Development Management Plan 2015.

7. No light from the lamp standards hereby permitted shall spill out onto ground outside the site boundary.

Reason: To help safeguard the amenities of the occupiers of residential properties in the vicinity of the site in accordance with Policies DM3 and HC3 of the Hastings Development Management Plan 2015.

8. In the event the spill shields do not operate as expected according to the requirements of Condition 7, further proposals to restrict the light spill shall be submitted for the consideration of the Director of Communities, Economy and Transport. Any further proposals shall be installed within one month of their approval.

Reason: To help safeguard the amenities of the occupiers of residential properties in the vicinity of the site in accordance with Policies DM3 and HC3 of the Hastings Development Management Plan 2015.

The policies relevant to this Decision are:-

Hastings Planning Strategy 2011-2028 (adopted February 2014): None of particular relevance.

Hasting Development Management Plan (adopted September 2015): DM3 (General Amenity) and HC3 (Community Facilities).

National Planning Policy Framework 2012:

The National Planning Policy Framework (NPPF) does not change the status of the Development Plan as the starting point for decision making but it does constitute guidance as a material consideration in determining planning applications. Part 8 (Promoting Healthy Communities) is relevant in this case and Paragraph 72 of the same part, advises Local Planning Authorities to give great weight to the need to alter and expand Schools.

Policy Statement on Planning for Schools Development:

The Policy Statement states that the planning system when dealing with planning applications for state-funded schools should operate positively and there should be a presumption in favour of the development of such Schools. The policy statement encourages a collaborative approach to applications, encouraging pre-application discussions and the use of planning obligations to help mitigate adverse effects of developments. Where it is required to impose conditions, they should be necessary in order to make development acceptable and be clearly justified, thereby demonstrably meeting the tests set out in Planning Practice Guidance, ‘Use of Planning Conditions’. The policy statement goes on to indicate that the Secretary of State will be minded to consider refusal of any application for state-funded schools to be unreasonable conduct, unless it is supported by clear and cogent evidence.

In determining this planning application, the County Council has worked with the applicant and agent in a positive and proactive manner. The Council has also sought views from consultees and neighbours and has considered these in preparing the recommendation. This approach has been taken positively and proactively in accordance with the requirement in the NPPF, and as set out in the Town and Country Planning (Development Management Procedure) (England) Order 2015.
