Queensland’sCoordinator-Generalhas the powerto declarea project a ‘coordinatedprojectforwhichanenvironmentalimpact statement (EIS) isrequired’under Part4, section26(a)oftheStateDevelopmentandPublicWorksOrganisationAct1971(SDPWO Act).

Thedeclarationtriggerstherequirementforaprojectproponentto prepareanEISandsubmitittothe Coordinator-General. The purpose ofanEISisto examineand addresstheproject’spotentialdirectandindirect environmental, socialandeconomicimpacts.

OncetheCoordinator-GeneraldecidestheEISisacceptable, itisreleasedforpublicandstategovernmentadvisoryagencyconsultation fora six-weekperiod.

Whyam Ibeingconsulted?

Thepublicandgovernmentadvisoryagenciesareinvited tomakeasubmissionon theEIS,includingthe project’spotentialenvironmentalimpactsandthe effectivenessofmeasures the proponentproposes tomanagethoseimpacts.

‘Properlymade’submissions

UndertheSDPWO Act, theCoordinator-Generalisnotobligedtoconsiderasubmissionthatisnot‘properlymade’.Also,toensureyouhaveappealrightsundertheSustainablePlanningAct2009,yoursubmissionmustbe ‘properlymade’.

Forasubmissiontobe‘properlymade’, itmust:

bemadetotheCoordinator-Generalinwriting

bereceivedonorbeforethe last day ofthesubmissionperiod

besignedbyeachpersonwhomakesthesubmission(or submittedonline)

statethenameandaddressofeachpersonwhomakesthesubmission

statethegroundsofthesubmissionandfactsandcircumstancesreliedon.

Whathappens next?

After consultationcloses, theCoordinator-Generalevaluatesthe EIS, submissionsonthe EISandanyadditionalinformationprovidedbythe projectproponent. TheCoordinator-Generalthenwritesanevaluationreport,eitherapprovingor refusingthe project.

Privacy

TheCoordinator-GeneralisauthorisedtocollectpersonalinformationunderSchedule 2andsection29 ofthe SDPWOAct. Your personalinformationwillbeusedforthe purposeofconsideringyoursubmission,completing the EISprocessandthe performanceof functionsunderthe Actandotherlegislationrelevanttotheproposedproject.

Yourpersonalinformationwillbedisclosed totheprojectproponent andother governmentagenciesinvolvedin the proposedproject, andisalsosubject to disclosure undertheRighttoInformationAct 2009.Yourpersonalinformationwillnototherwisebedisclosed,unlessdisclosureisauthorisedor requiredbylaw,orispermittedunder theInformationPrivacyAct2009.
