Female Guardian Contract Summary

OWNERSHIP- Breeder

Breeder retains sole ownership of dog and any puppies that are whelped until the termination of the contract. Ownership transfers to Guardian upon fulfilment of contract.

POSSESSION- Guardian

Guardian is responsible for physical care and supervision of puppy. The puppy remains un-spayed until 5 years of age.

BREEDER’S RIGHTS AND OBLIGATIONS

Breeder has the right to take puppy to vet visits for reproductive health, for 24 hour puppy sleepovers once every 3 months to bond with puppy, for one week during her heat cycle to breed, and for another 7-ish weeks to whelp and wean her litter. Ample notice of these visits will be given to Guardian. Breeder requires that Guardian feed grain-free food, monitor for food allergies, and follow all veterinary recommended vaccination schedules. Primary Veterinarian to be decided mutually, but Reproductive Vet is Pilchuck Veterinary Hospital.

GUARDIAN’S OBLIGATIONS

Guardian makes a security deposit of $2000, which represents fair market value of the dog on a pet contract. Two litters are expected in the breeding career, where $1,000 is returned with each successful litter. Guardian must keep dog contained by fence at home and by leash elsewhere, unless at an off-leash facility, provide regular exercise and not allow to become obese, provide obedience training (through kindergarten puppy classes) and obtain the Canine Good Citizen title within the first year. Guardian will provide all food and pay for wellness vet visits, following any and all veterinary-recommended vaccinations and medications. Guardian will notify and consult with breeder if major non-emergency procedures are needed. Guardian will notify Breeder of scheduled vacations or other absences from the area that may coincide with breeding times; Any boarding or dog-sitting facility needs to be approved by breeder, but Breeder will attempt to dog-sit whenever possible. Guardian will maintain residence in the greater Seattle area for the duration of the contract and keep breeder aware of current contact information.

DEATH OF DOG

If accidental death of dog occurs in Guardian’s care, the contract is void and Guardian forfeits any remaining security deposit to the Breeder. If accidental death of dog occurs in Breeder’s care, Guardian will be offered a return of the remaining security deposit or a pet-contract puppy from the next available litter. Death due to complications during pregnancy and whelping will result in refunding of remaining security deposit to Guardian.

CONTRACT TERMINATION

The contract is fulfilled after 5 years, and at that time the female is spayed at Breeder’s expense.

If after 3 years, the dog is found to have deficiencies that prevent her from being used as breeding stock, Breeder will transfer ownership to Guardian after proof of spay at Guardian’s expense.

Contract is void in cases of severe negligence but whenever possible the Breeder will work with Guardian to improve care prior to removing the dog. Severe negligence is when:

a) the dog is allowed to run loose when there is no supervision,

b) the dog gets bred by accident,

c) Guardian does not notify the Breeder when the dog comes in season,

d) the dog is neglected or abused (at Breeder discretion),

e) Guardian moves before notifying the Breeder,

f) or the dog must be rescued from an Animal Control facility.

Guardian may return dog at any time for a refund of the remaining security deposit, provided the dog is still in good health per DVM of Breeder’s choosing.

BREACH OF CONTRACT

Guardian agrees to pay Breeder $2,000 and forfeits security deposit if any of the following occur:

Guardian spays or breeds dog without Breeder’s consent

Guardian intentionally causes harm to the dog or prevents dog from breeding

Guardian ceases communications with the Breeder
