Justin City Council Regular Session Meeting–

The Justin City Council Meeting convened into a Regular Session being open to the public the 9th day of November at 7:00 p.m. in the Council Chambers of Justin Municipal Complex, and notice of said meeting giving the time, place, date and subject thereof having been posted as prescribed by Article 5 of the Texas Government Code, with the following members present and in attendance to wit:

Mayor Greg Scott, Mayor Pro-Tem David Speicher, Council Members: Stephen Chambers, Lisa Cate and Lisa Jayjohn, and Conrad Jimison. City Staff: City Secretary Kim Strange, City Manager Ashley Stathatos, Police Chief Bill Brooks, Public Works Director Jon Wells, EDC Director Shani Ihnfeldt, EDC Assistant Director Eliza Tellez, Progressive Waste Management Representatives Kim Flood, Norm Bulaich, and Bill Osweiler, Residents: Alan Woodall, David Wilson and Jim Tate.

I.  CALL TO ORDER

Invocation and Pledge of Allegiance by Mayor Pro Tem David Speicher.

II.  ACTION ITEMS

1.  Consider and act on providing City Services to Justin ETJ and surrounding areas.

2.  Consider and act contract with Progressive Waste Solutions.

Council Member Stephen Chambers made a motion to instruct staff to prepare a contract with tonight’s instructions which include a four-year contract, 4,000 sponsorships, brand new polycart for each home. Take out CPI, every increase should come to Council for approval. Also include a 90 day out clause with justification to be approved on the November 30, 2015. Motion was seconded by Council Member Lisa Cate.

3.  Consider and act on the approval of the City of Justin Capital Improvements Plan.

Mayor Pro-Tem Dave Speicher made a motion to approve the City of Justin Capital Improvement Plan. Motion was seconded by Council Member Stephen Chambers.

4.  Consider and act on Ordinance 600-15 declaring a moratorium on accepting and issuing permits for the erection of signs.

Mayor Pro-Tem David Speicher made a motion to approve Ordinance 600-15 declaring a moratorium on accepting and issuing permits for the erection of signs. Motion was seconded by Council Member Stephen Chambers. Council Member Lisa Cate advised she would like to move quickly on the sign ordinance. City Manager Ashley Stathatos advised the sign ordinance will be voted on at the December regular Council Meeting.

5.  Consider and act on nominations for Denton Central Appraisal District Board of Directors.

No action was taken on this issue.

III.  CONSENT ITEMS

6  Consider and act on approval of minutes for the City Council Meetings dated May 11, 2015, June 8, 2015, July 13, 2015, August 10, 2015, August 31, 2015, September 14, and October 12, 2015.

7  Consider and act on approval of the Investment Report dated September 30, 2015.

Council Member Stephen Chambers made a motion to approve consent items. Council Member Lisa Jayjohn seconded the motion.

IV.  EXECUTIVE SESSION

As authorized by Section 551.071 (2) of the Texas Government Code, the City Council may adjourn into closed executive session to seek confidential legal advice from the City Attorney.

Council convened into Executive Session at 7:23 pm

·  Discuss Cause No. 15-08170-367, Town of Northlake versus City of Justin challenging the expansion and extension of Justin’s extraterritorial jurisdiction being a 74.174 tract of land in the Mary Polk Survey, Abstract Number 993, south of John Wiley Road and east of Boss Range Road.

·  Discuss Cause No. 2009-00779, Rimrock Enterprises, Inc. versus City of Justin.

Council reconvened into Regular session at 8:20 pm.

6.  Consider and act on executive session items in open session.

No action was taken. Advised that staff has been directed.

V. ADJOURN

Council Member Lisa Cate made a motion to adjourn and Stephen Chambers Seconded the motion.
