Terms and Conditions

Summary

The Green Wedge Public Art Incubator (GWPAI) program is managed by Arts and Cultural Development (ACD) of Nillumbik Shire Council (Council). GWPAI supports professional contemporary artists to advance their artistic practice through investigative public art projects that interpret the Green Wedge landscape and advance the creative capacity of the Shire and its community. The identified GWPAI sites are only available for Council sanctioned projects that form part of the GWPAI program. Artists are invited to apply for the program from March to April 2017. Applications are assessed by a selection panel in May.

Eligibility and selection criteria

·  Selection of applicants will be based on the Selection Criteria:

-  Originality of the artistic concept and outcome;

-  Innovative approach to using the site(s) and referencing the Green Wedge;

-  Uniqueness and integration of community engagement opportunities into the creative idea;

-  Concept feasibility including capacity to undertake the project within the proposed timeframe and budget;

-  Artist merit and innovative approach to the artist(s)’ previous work

·  Current employees and councillors of Nillumbik Shire Council are ineligible to apply.

·  Expressions of Interest must be submitted by midnight on the closing date using the application form.

Assistance to Artists

As part of Council’s commitment and support to local artists, Arts & Cultural Services (ACD) will:

·  Assist artists to obtain any necessary permits and permissions

·  Assist artists to make connections with the local community

·  Coordinate and promote any associated events and programs (as applicable)

·  Assist with sourcing resources and the installation of artworks and/or other project outcomes (as applicable)

·  Work with artists to promote projects to the local media

·  Promote the project in relevant ACD promotional material and platforms

·  Provide up to a maximum of $3,000 as per the agreed budget per project for artists to develop and deliver their projects

Artist(s)’ responsibilities

It is the responsibility of the artist(s) to:

·  Advise Council of significant changes to the agreed project proposal (such as outcome, content, participants). In the event of significant changes Council reserves the right to review the viability of the project in the program

·  Enter into a Minor Services Agreement with Council to deliver the project

·  Provide information for promotion to ACD as required

·  Acknowledge Council (including Council logos) on all publicity material

·  Report any incident/accident to the Arts & Cultural Programs Officer.

Content

Council expects, at minimum, that artists are lawful at all times and accordingly consider issues of copyright, decency, slander and racism. Council takes no responsibility for the content presented, and has the final say about whether or not works are displayed. Artists must discuss their responsibility and liability with the Arts and Cultural Programs Officer prior to undertaking their project.

Installation of works

To maintain best practice for the GWPAI program and safe spaces it is essential that each artist adhere to the following:

·  It is the artist’s responsibility to physically install their work and move equipment. The exhibitor must organise an assistant to help them install their work if required.

·  The use or installation of equipment must be discussed with ACD prior to the project.

·  Uses of internal walls, pillars or display boards must be discussed and approved by ACD.

·  Use of banners, drapes, tables and other furniture must be discussed with ACD.

·  Only labels produced by Council can be used.

·  Walls and floors of Council assets should not be pierced or marked by nails, pins, screws or any other equipment without prior permission. Only white tac may be used to affix labels.

·  Use of Council plinths must be discussed with ACD prior to the project set up and booked well in advance.

·  If using Council plinths, two people must move each plinth. Plinths should not be dragged on a visible face. Plinths should be cleaned before and after use, and touched up with paint if required.

·  While installing, use barrier tape to close off the area to the public (if applicable).

·  Remove all rubbish after install and de-install (as applicable). Return the spaces as found and meet the costs to replace and or repair damaged Council equipment/resources.

·  It is the artist’s responsibility to ensure safe anchoring of artworks, in particular, three-dimensional works. Museum wax or an equivalent is recommended to anchor fragile works, such as ceramics to plinths to guard against falling and breaking.

Insurance

While buildings and assets are insured under Council’s primary public liability insurance, artwork is not covered by Council’s insurance. Council takes no responsibility for any theft, loss or damage to artwork during transportation or display as part of the Green Wedge Public Art Incubator Project (GWPAI).

It is essential that all artists involved in projects have public liability insurance of a minimum of ten million dollars for the duration of their project (including installation and dismantling) or associated events, including exhibition openings. This covers individuals against accidents caused in the space only.

A certificate of currency must be provided to the Arts & Cultural Programs Officer () prior to the project commencement.

Council can assist artists to obtain Council’s secondary public liability insurance, which is available to users of Council owned spaces. This costs $22 and covers the duration of the project period. Terms and conditions apply.

Nillumbik Shire Council’s insurance does not cover buildings and assets not owned by the Council.

Occupational health and safety

GWPAI projects will occur in public spaces. Artists have a responsibility to protect their own health and safety, as well as the health and safety of all visitors and participants. In order to minimise workplace injuries such as slips, trips and falls, work areas need to be kept clean and tidy at all times, including when installing and dismantling projects.

Injuries associated with installing and dismantling artworks are usually a result of poor manual handling skills. It is imperative that proper lifting techniques are employed. All loads should be tested prior to lifting and where the weight exceeds 20kg or the width of an object is greater than one metre, it is the artist’s responsibility to seek and organise assistance. If using the ladder, two people must be present; one person on the ladder and the other person on the floor spotting the climber. In accordance with Occupational Health and Safety regulations, no one is to climb a ladder beyond a height of two metres.

Smoking is not permitted in Council buildings and or bus.

Unforeseen expenses

Council is not liable for expenses incurred by artists, or others involved, for expenses outside of the agreed project budget and scope.

Unforeseen circumstances or emergency

In unforeseen circumstances or an emergency ACD may be required to move or alter the Artist’s artwork. Council also reserves the right to use any hall at any time for community evacuations.

Security of the work

The GWPAI public spaces are often unmanned spaces with high traffic areas. Artists exhibit their work at their own risk. Artists may choose to organise insurance depending on the nature of their project, at their own cost. Electronic surveillance is not present at the venues.

Disputes

In the event of any dispute or difference arising as to the interpretation of these conditions, or of any matter or thing contained therein, the decision of the Nillumbik Shire Council Chief Executive Officer shall be final and conclusive.

Privacy notification

By providing personal information when applying for GWPAI, artists understand and accept that the information will be used solely for this purpose. Artists may apply to Council for access for amendment to this information at any time.
