WELDING REPAIR & FABRICATION SERVICES
SCOPE OF WORK:
The City of Albuquerque (City) is soliciting a bid for Welding Repair & Fabrication Services that can be used by various departments within the City. These services may include
· metal fabrication
· mig welding, tig welding and arc welding,
· sheet metal work
· welding of stainless steel, aluminum, and steel
· oxy acetylene (gas)
· And on occasion, a plasma cutter may be used
The City shall award this contract to a primary, secondary and tertiary vendor. No successful vendor should have any expectation of any level of purchases against a resulting contract.
BID REQUIREMENTS:
Contractor shall submit copies of all current Certified Welder Certificates with their bid package for all types of welding in which they are qualified. Failure to submit these certificates may be cause for rejection of your bid.
If awarded, the Contractors will be required to submit a Certificate of Liability Insurance naming the City of Albuquerque as Additional Insured.
Within 24 hours after notification of a job, contractor shall make a site inspection (if required) and provide a written estimate based on prices bid herein. The 24 hour deadline may be extended by the Department if required. All estimates must provide a breakdown of labor hours, materials costs, and equipment cost.
· Contractor shall use the site inspections to ascertain if there are any discrepancies from the work being requested and the bid items so a solution can be agreed upon prior to the work being started.
· During the site inspection if the contractor detects or anticipates a problem that may interfere with the work, they shall immediately notify the department. The contractor shall not begin any work until the problem has been corrected.
If a contractor is awarded a project they will be required to submit a Welding Procedure Specification (WPS) for that project for approval by the Department prior to the work beginning.
Hourly rates are defined as actual time worked. Hourly rates for personnel shall commence upon arrival at work site, and shall end when the personnel leave the work site. No travel time shall be paid for under this contract.
If the Contractor is required to pick up and deliver materials back to any facility located within the City of Albuquerque the Contract may charge a one (1) time Service/Mobilization Fee per project. If the City wishes to deliver and pick up their own materials from the Contractors shop then no fee is allowed for Service/Mobilization.
Shop hours will only be paid for actual hours spent working on the material.
All shop & welding services shall be completed with seven (7) working days of the receipt of the CRO from the department, unless a longer time is agreed upon by the department.
Contractor shall provide cost plus percentage for any materials used in the fabrication process. These materials would normally include (but not limited to) any new tubing, bar, sheet metal, steel etc. These materials do not include any shop supplies (welding rods, gas, etc.) that are used in the normal day to day welding process.
Contractor must request and be issued a Contract Release Order (CRO) number by the requesting Department or Division prior to performing services.
The Contractor shall provide competent supervision and skilled personnel to carry on all work that is being done.
The Contractor shall comply with all local, State, and Federal regulations governing safety, health and all sanitation. The contractor shall provide all safeguards, safety devices and protective equipment, and to take any other needed actions necessary to protect the life and health of their employees on-the-job and the safety of the public, and to protect property in connection with the performance of the work.
It shall be the responsibility of the Contractor to obtain any and all licenses and/or permits required for the Scope of Service outlined herein.
The contractor shall furnish all equipment, labor, material and tools required to perform the work specified. No other compensation shall be given other than the bid pricing.
The Contractor shall be responsible for the project being completed in a timely manner and in accordance with the specifications.
The Contractor shall be responsible for all clean-up of materials resulting from the performance of this work before a final inspection is conducted and the work is accepted.
The Contractor shall be required to complete all on-site work during normal City business hours (7:30am to 5:30pm Monday through Friday). On occasion the Contractors may be required/asked to perform work during non-working hours (5:31pm to 7:29 am) and or weekends and holidays. All repairs including after-hours, weekend and holiday work must be approved in writing by the requesting Department Director, or his designee. The Contractor will be paid under the appropriate bid item for these services.
Emergency Services; whenever lives and/or property are at risk or the normal operation of a department is halted. Response time is to be within 1-1/2 hours of request, 24 hours a day, 7 days a week. Shop repair turnaround time shall be no more than two (2) calendar days. The Contractor will be paid under the appropriate bid item for these services.
Contractor shall answer all questions in Appendix A and submit those answers in their bid package.
ASSIGNABILITY:
The Contractor shall not assign any interest in this contract and shall not transfer any interest in this contract (whether by assignment or notation) without prior written consent of the City hereto.
INDEPENDENT CONTRACTOR:
The Contractor is not considered an employee of the City for any purpose whatsoever. The Contractor is considered an independent contractor at all times in the performance of the services. The Contractor further agrees that it is not entitled to any benefits from the City under provisions of the Workers' Compensation Act of the State of New Mexico or to any of the benefits granted to employees of the City under the provisions of the Merit System Ordinance as now enacted or hereafter amended.
Subcontractors
· The Contractor may sub-contract minor portions to qualified and licensed subcontractors.
· The City must be notified of and must approve the proposed sub-contractor before the Contractor may enter into such an agreement. If a Contractor wishes to use a sub-contractor and the City approves the use then the sub-contractor is required to furnish their own Certificate of Insurance to the City Purchasing Department if they will be working on City property.
· The Contractor may submit itemized invoices for payment of approved sub-contractor at cost plus no more than ten percent (10%) mark-up.
· The Contractor shall be fully responsible for work and payment of the subcontractor to the full extent of the requirements of the contract.
INSPECTION AND FINAL ACCEPTANCE:
All work is subject to inspection by the City during progress and after completion.
· Final written acceptance or rejection of the work shall be made by the City promptly after the vendor has notified the Facility official or designee that the project is ready for final inspection.
· If any work is not satisfactorily performed or otherwise not in conformity with the requirements of this contract and Federal, State and local codes, the City shall have the right to require its correction or to require replacement, at Contractor's expense.
· If the work performed is of such a nature that the defect cannot be corrected by re-performance of the services, the City shall have the right to; Require the Contractor to immediately take all steps necessary to ensure future performance of the services in conformity with the requirements of this Contract and/or Reduce the price to reflect the reduced value of the services performed.
INVOICING AND FINAL PAYMENT:
Contractor shall submit an invoice to the City of Albuquerque Accounts Payable Division and one to the requesting Department, delineating all charges upon completion of the Contract Release Order (CRO). Payment for services and materials will be contingent upon final inspection and acceptance by the requesting Department/Division.
All invoices shall include the following documentation:
· Contract Release Order (CRO)

· Requesters Name
· City of Albuquerque Work order
· Service Date
· Service Time
· Work Sheet/Job Ticket No.
· Summary Description of Services and Material provided.
· If applicable, subcontractor’s services
· Itemized Material and Labor cost provided
· Charges for material must be itemized separately.
· Verification of cost of Material (for repairs)
· Lien Releases relating to all services and material provided.
· Total Amount of Invoice
City reserves the right to request all invoices for sub-contractors that may be used on the requested project.
Included with the invoice will be the written notification of permission to proceed, and acceptance by the City of final approval.
