1. Definitions:

a)Golf buggy hire Ltd is “The Owner” and includes any trading names and subsidiaries and/or their successors, personal representatives or assigns.

b)The “Hirer” is the firm, person, corporation, company or public authority, including their representative or successors, who hire vehicle(s) from, or carry out business with, Golf buggy hire Ltd.

c)“Vehicle/s” covers all types of equipment, vehicles, accessories and machinery which Golf buggy hire Ltd agrees to hire to the Hirer.

2. Contract Extent: No conditions other than those of Golf buggy hire Ltd shall prevail.

3. Acceptance of Terms and Conditions: When the Hirer confirms an order and/or the site accepts a vehicle, whichever is the former, the Hirer is deemed to accept Golf buggy hire Ltd Terms and Conditions.

4. Delivery: All vehicles will be deemed to be undamaged and in full working order at the point of hire, unless the Hirer notifies Golf buggy hire Ltd to the contrary upon receipt of the vehicle/s.

5. Unloading: Golf buggy hire Ltd shall not be responsible for damage to any vehicle, equipment or surface of property during the unloading or loading of the vehicle/s upon delivery or collection, howsoever caused.

6. The Vehicle/s:

a. The Hirer is responsible for the security, correct use, and safe return on completion of the hire, of all “vehicle/s” hired.

b. The Hirer is responsible for the provision of oil and fuel at their expense, unless specifically requested for the vehicle/s to be fully fuelled.

c. The Hirer will be totally responsible for the safe use of the vehicle.

d. The Hirer is responsible for the reporting of, and payment of rectification costs for all damage (except for fair wear and tear) to the vehicle whilst the vehicle is on site, together with any consequential loss whilst repairs are carried out.

e. The hirer is totally responsible for all punctures and tyre damage whilst the vehicle/s are on hire.

f. Highway use. Golf buggy hire vehicles are not road legal, and must not be used on public highways unless they clearly display registration plates and a valid tax disc appropriate to the vehicle hired.

f. Congestion charges. Golf buggy hire Ltd accept no responsibility for charges relating to their vehicles being operated in congestion zones. Any arrangement and costs applicable must be undertaken by the hirer. Please note: Electric vehicles are not automatically exempt from charges.

7. Accessories; All accessories where supplied, spare wheels & tyres / battery chargers /jerry cans/ wheel braces, are the Hirers responsibility. Any loss or damage will be charged for at replacement costs.

8. Inspection and Servicing: The Hirer shall allow access to Golf buggy hire Ltd, their agents and their insurers, at all reasonable times, to inspect, repair, test or service any vehicle/s. Such work will be carried out at times convenient to and with the agreement of the Hirer wherever practical.

9. Operators/Drivers: The Hirer must at all times ensure that the “vehicle/s” are operated and driven by competent personnel/operators.

10. Vehicle Operation: Accepting Golf buggy hire Ltd vehicle/s on site specifically implies that the Hirer is conversant with the vehicle/s and their associated requirements, as well as the safe operation and storage. The Hirer confirms that they will not allow any other person who is not competent and fully trained to operate or use the vehicle/s. If the Hirer has any queries in respect of the safetyor other regulations governing the use of the vehicle/s, they must immediately contact Golf buggy hire Ltd.

11. Repairs and Breakdowns:

Any breakdown or loss of performance must be reported to Golf buggy hire Ltd immediately. The Hirer shall not repair any vehicle, except tyre damage or punctures, without the express permission of Golf buggy hire Ltd. Golf buggy hire Ltd do not accept any liability for consequential loss in the event of any breakdown or loss of performance.
The Hirer is responsible for all costs and losses incurred by Golf buggy hire Ltd, resulting from a breakdown and/or damage arising from misuse or Hirer negligence. (See 6d.)
Repairs During Hire: Vehicle repairs may need to be carried out during the hire. If the vehicle needs to be removed from site, a replacement vehicle or alternative will be supplied subject to availability at no additional cost to the Hirer.

12. Loss and Damage: The Hirer shall make good to Golf buggy hire Ltd all damage to or the loss to the vehicle howsoever caused, excluding fair wear and tear. (See 6d)

13: Insurance: The Hirer is totally responsible for the insurance of all vehicle/s whilst on hire to them. Golf buggy hire will provide on request a valuation, for insurance purposes, for any vehicle/s on hire.

14. Indemnity: The Hirer shall fully indemnify Golf buggy hire Ltd in respect of all claims, caused by, or in connection with, the use of the vehicle while on hire.

15. Collection: Upon collection of vehicle from site, the Golf buggy hire Ltd driver and the site representative of the Hirer shall examine the vehicle and record details of any damage/s or deficiencies including photographic evidence.

16. Rights of Golf buggy hire Ltd: The Hirer shall not re-hire, sell, mortgage, charge, pledge or part with possession of any vehicle/s whilst in their possession.

17. Site of contract: The Hirer must not remove any vehicle/s from the original delivery site specified to any other site or location without the prior written consent of Golf buggy hire Ltd.

18 Commencement and Termination of Hire.

Will be as specified on the quotation and as agreed on the order confirmation received from the Hirer.

If the vehicle is collected, the hire shall commence from the time that the vehicle/s are signed for and collected, and shall continue until the vehicle/s are returned back to Golf buggy hire Ltd and a returns note given to the Hirer.

In the case of any damage to the vehicle/s the Hirer is responsible for the payment of all rectification costs for all damage, together with any consequential loss whilst repairs are carried out.

19. Other Stoppages.

Golf buggy hire Ltd will not accept claims or extensions to the hire period for stoppages through causes outside their control, such as bad ground conditions, bad weather, the failure of another item of vehicle (whether owned by Golf buggy hire Ltd or not), punctures or tyre repairs.

20 Notice of Termination of Hire.

a. When a fixed period of hire is agreed, no termination notice is necessary and the vehicle/s will be collected automatically or if a self collect /delivery the vehicle/s will be returned.

b. If the hire period is unknown at the outset, (or if fixed becomes indeterminate), the hire may only be determined by the Hirer giving seven (7) days notice of off-hire to Golf buggy hire Ltd.

c. If no notification of off hire is given seven (7) days hire will be charged by Golf buggy hire Ltd from the date of notification.

21.Consumables and Fuel Supplies.

a. All consumables - oil, grease, fuel etc are the responsibility of the Hirer.

b. All petrol vehicle/s provided by Golf buggy hire Ltd will only be supplied with sufficient fuel at the commencement of the hire to get the vehicle going.

c. Where specifically requested,, and, where vehicle/s have been supplied fully fuelled, all fuel supplied by Golf buggy hire Ltd will be charged out and incorporated within the agreed contract price.

22. Owners Name: The Hirer shall not cover up, remove or deface Golf buggy hire Ltd signs, stickers or nameplates, nor fix to the vehicle any sign or sticker, nor paint any part of the vehicle, without prior written consent.

In the event of any such damage to signs, stickers, nameplates or vehicle/s the Hirer will be responsible for all of the costs of repairing the damage.

23. Delivery and Collection of vehicle/s:

Golf buggy hire Ltd will within the agreed contract price deliver and collect to/from the agreed site address.

In the event of any other specific agreement the Hirer will be responsible for payment of transport to and from his site.

24. Cancellation of Order

For vehicles held in reserve for customers the following cancellation charges shall apply.

Cancellation 2 weeks prior to event, a 30% charge shall be payable based upon the agreed contract price.

Cancellation 1 week prior to event, a 60% charge shall be payable based upon the agreed contract price.

Cancellation 3 days or less prior to the event, a 100% charge based upon the agreed contract price.

25. Terms of Payment.

Unless agreed differently the following terms apply.

Deposit: Golf buggy hire Ltd will invoice 30% of the agreed contract price, payable immediately with order.

Balance; Golf buggy hire Ltd will invoice the balance of the purchase order, payable prior to delivery unless credit terms have been previously agreed..

Credit Accounts: Terms of payment are net 30 days monthly from the date of invoice. A daily interest charge will be applied if payment is not made within this period.

26. Change of Ownership/Directorship of Hirer.

Golf buggy hire Ltd reserve the right to continue or determine any contract at their sole discretion, in the event of any change of ownership/directorship of the Hirer.

27.By signing this document the Hirer agrees to the terms and conditions set out in articles 1 to 26.
