Addendum

The following communication, dated 26 June 2015, is being circulated at the request of the delegation ofthe Separate Customs Territory of Taiwan, Penghu, Kinmen and Matsu.

The Separate Customs Territory of Taiwan, Penghu, Kinmen and Matsu would like to notify that the "labelling requirements for prepackaged food, food additives and unpackaged food containing ingredients of genetically modified organisms", as per G/TBT/N/TPKM/168/Rev.1 on 17 Mar 2015, was announced on 29 May 2015. Below is some important information concerning the measures:

The implementation date for prepackaged food and food additives will be 31 Dec 2015. For unpackaged food, the requirements will be implemented in a phased manner, starting from 1 July 2015 to 31 Dec 2015.

-Phase 1: The GMOs in agricultural product type or GMOs that have simply been dissected or ground sold by registered food vendors shall comply with the requirements from 1July 2015.

-Phase 2: The following food products and vendors shall comply with the respective requirements from 1 Oct 2015.

(1)Soy-milk, tofu, tohua (bean curd), dried-tofu, dried-curd-skin, and other vegetarian meat products made with soy protein sold by registered food chain vendors.

(2) The GMOs in agricultural product type or GMOs that have simply been dissected or grinded sold by non-registered food vendors.

-Phase 3: Soy-milk, tofu, tohua (bean curd), dried-tofu, dried-curd-skin, and other vegetarian meat products made with soy protein sold by registered food non-chain vendors and non-registered food vendors shall comply with the requirements from 31 Dec 2015.

Food or food additives that use GMOs directly during the manufacturing process yet the final product does not contain transgenic DNA fragments or transgenic proteins will be required that one of the following expressions be labelled on the product:

(1)“genetically-modified”, “with genetic modification” or “use genetically modified ______(organisms)”;

(2)“this product is made of genetically modified ______(organisms), but does not contain any transgenic DNA fragment or transgenic proteins ” or “this product’s raw materials contain genetically modified ______(organisms), but does not contain any transgenic DNA fragment or transgenic proteins”, or

(3)“this product does not contain any transgenic DNA fragment or transgenic proteins, but is made of genetically modified ______(organisms)”, or “this product does not contain any transgenic DNA fragment or transgenic protein, but with genetically modified ______(organisms)”.

Food containing non-GMOs can be labelled “non-genetically-modified” or “with non-genetic modification” only under the circumstance that international approvals exist for the corresponding GMOs to be cultivated or used as raw materials for food.

The proposed regulations are modified for the purpose to advance and offer consumer adequate information.
