PROPOSED AMENDMENT TO INTERAGENCY AGREEMENT TO PROVIDE FUNDING SUPPORT FOR THE OFFICE OF THE SECRETARY FOR ENVIRONMENTAL PROTECTION.

DISCUSSION:

Each fiscal year, the Board enters into an interagency agreement with the Office of the Secretary for Environmental Protection to provide partial funding for California Environmental Protection Agency (Cal/EPA) staffing and operating costs. This agreement implements the funding authorized in the Annual Budget Act. The Budget Act appropriation reflects a "pro rata" approach by assigning each Cal/EPA Board, Department or Office (BDO) a proportionate share of Cal/EPA support as determined by the number of staff in each BDO. The Board approved an initial agreement with Cal/EPA in November 2002 to provide $891,000 towards the SWRCB’s "pro rata" share of the costs. The proposed amendment would provide the balance of funds needed for the SWRCB’s full share of costs.

Funds are available for support of this interagency agreement, which totals $549,000

STAFF RECOMMENDATION:

That the Board adopt a resolution authorizing the Executive Director, or her designee, to negotiate and execute an amendment to the interagency agreement with the Office of the Secretary for Environmental Protection to provide additional funding for support of Cal/EPA activities in an amount not to exceed $549,000 for FY 2002-03.

AUTHORIZING NEGOTIATION AND EXECUTION OF AN INTERAGENCY AGREEMENT BETWEEN THE STATE WATER RESOURCES CONTROL BOARD AND THE OFFICE OF THE SECRETARY FOR ENVIRONMENTAL PROTECTION TO PROVIDE FUNDING FOR SUPPORT OF CALIFORNIA ENVIRONMENTAL PROTECTION AGENCY ACTIVITIES FOR FY 2002-03

WHEREAS:

1. The 2002 Budget Act authorized funding on a "pro rata" basis from each Cal/EPA Board, Department or Office to provide funding for support of California Environmental Protection Agency activities for FY 2002-03.

2. The Board is one of the organizations under Cal/EPA.

  1. Each fiscal year the Board enters into an interagency agreement with the Office of the Secretary for Environmental Protection to provide funding for Cal/EPA staffing and operating costs.
  2. The Board approved in November 2002 an interagency agreement which provided a portion of the SWRCB "pro rata" share if costs.

THEREFORE BE IT RESOLVED:

That the State Water Board authorizes the Executive Director or her designee to negotiate and execute an amendment to the interagency agreement with the Office of the Secretary for Environmental Protection to provide additional funding for support of Cal/EPA activities in an amount not to exceed $549,000 for Fiscal Year 2002-03.
