The following, together with any attachments, is hereby submitted as a Subcontracting Plan to satisfy the applicable requirements of FAR 52.219-9 Small Business Subcontracting Plan (Jan 2017).
1.The following goals, expressed in terms of percentages of total planned subcontracting dollars, apply to the subcontract awarded under the solicitation cited above or to the subcontract cited above.

4.The method used to develop the subcontracting goals specified in section 1 above is described on a sheet attached hereto. (Include a statement explaining how the product and service areas to be subcontracted were established, how the areas to be subcontracted to small business, veteran-owned small business, service-disabled veteran-owned small business, HUBZone small business, small disadvantaged business and women-owned small business concerns were determined, and how capabilities of small business, veteran-owned small business, service disabled-veteran owned small business, HUBZone small business, small disadvantaged business concerns, and women-owned small business were determined to include identification of source lists used in making those determinations.)
5.The method used to identify potential sources for solicitation purposes (e.g., existing company source lists, the System for Award Management (SAM) web site, veterans service organizations, the National Minority Purchasing Council Vendor Information Service, the Research and Information Division of the Minority Business Development Agency in the Department of Commerce, or small, HUBZone, small disadvantaged, and women-owned small business trade associations) is described on a sheet attached hereto.

(a)The individual listed above has general overall responsibility for compliance with this company’s Small Business Subcontracting Plan; for the development, preparation and execution of individual subcontracting plans; and for monitoring performance for contractual subcontracting requirements contained in this plan, including but is not limited to:
(i)Ensuring that procurement packages are structured to permit small business, veteran-owned small business, service-disabled veteran-owned small business, HUBZone small business, small disadvantaged business and women-owned small business concerns to participate to the maximum extent possible;
(ii)Ensuring inclusion of small business, veteran-owned small business, service disabled veteran-owned, HUBZone small business, small disadvantaged business and women-owned small business concerns in all solicitations for products or services that they are capable of providing;
(iii)Reviewing solicitations, when possible, to remove statements, clauses, etc., that may tend to restrict or prohibit small business, veteran-owned small business, service-disabled veteran-owned small business, HUBZone small business, small disadvantaged business and women-owned small business participation;
(iv)Ensuring that the review board for bids/proposals documents its reasons for not selecting low bids/proposals submitted by responsible small business, veteran-owned small business, service-disabled veteran-owned small business, small disadvantaged business and women-owned small business concerns;
(v) Ensuring the establishment and maintenance of records of solicitations and subcontract award activity;
(vi)Monitoring attainment of proposed goals; and
(vii)Preparing and submitting required semi-annual subcontracting reports using the Electronic Subcontracting Reporting System (eSRS) at .
(b)This person’s specific duties, as they relate to the offeror’s/subcontractor’s subcontracting program, include the following:
8.The efforts that will be made to assure that small business, veteran-owned small business, service disabled veteran-owned small business, HUBZone small business, small disadvantaged business, and women-owned small business concerns have an equitable opportunity to compete for subcontracts are described on a sheet attached hereto.
9.The offeror/subcontractor agrees to: (1) include the FAR clause of this subcontract entitled “Utilization of Small Business Concerns” in all subcontracts that offer further subcontracting opportunities, and (2) require all subcontractors (except small business concerns) that receive subcontracts in excess of $700,000 ($1.5 million for construction of any public facility with further subcontracting possibilities) with further subcontracting possibilities to adopt a subcontracting plan that complies with the requirements of FAR 52.219-9 Small Business Subcontracting Plan (Jan 2017).
10.The offeror/subcontractor will:
(a)cooperate in any studies or surveys as may be required;
(b)submit periodic reports so that Los Alamos National Security, LLC (LANS) can determine the extent of compliance by the offeror/subcontractor with the subcontracting plan;
(c)submit the Individual Subcontracting Report (ISR) and/or the Summary Subcontract Report (SSR), in accordance with paragraph (l) of FAR 52.219-9 Small Business Subcontracting Plan (Jan2017) using the Electronic Subcontracting Reporting System (eSRS) at . The reports shall provide information on subcontract awards to small business concerns (including ANCs and Indian tribes that are not small businesses), veteran-owned small business concerns, service-disabled veteran-owned small business concerns, HUBZone small business concerns, small disadvantaged business concerns (including ANCs and Indian tribes that have not been certified by the Small Business Administration as small disadvantaged businesses), and women-owned small business concerns in accordance with the instructions provided on the forms;
(d)ensure that its immediate next-tier subcontractors with subcontracting plans agree to submit the ISR and/or the SSR using eSRS;
(e)provide its prime contract number, its DUNS number, and the e-mail address of the offeror’s official responsible for acknowledging receipt of or rejecting the ISRs, to all first-tier subcontractors with subcontracting plans so they can enter this information into the eSRS when submitting their ISRs; and
(f)require that each subcontractor with a subcontracting plan provide the prime contract number, its own DUNS number, and the e-mail address of the subcontractor’s official responsible for acknowledging receipt of or rejecting the ISRs, to its subcontractors with subcontracting plans.
11.The offeror/subcontractor agrees that it will maintain the following types of records to document compliance with this Subcontracting Plan:
(a)Source lists (e.g., SAM), guides, and other data that identify small business, veteran-owned small business, service-disabled veteran-owned small business, HUBZone small business, small disadvantaged business and women-women owned small business concerns;
(b)Organizations contacted in an attempt to locate sources that are small business, veteran-owned small business, service-disabled veteran-owned small business, HUBZone small business, small disadvantaged business and women-owned small business sources.
(c)Records on all subcontract solicitations resulting in an award over $150,000 indicating:
(1)Whether small business concerns were solicited and, if not, why not;
(2)Whether veteran-owned small business concerns were solicited and, if not, why not;
(3)Whether service-disabled veteran-owned small business concerns were solicited and, if not, why not;
(4)Whether HUBZone small business concerns were solicited and, if not, why not;
(5)Whether small disadvantaged business concerns were solicited and, if not, why not;
(6)Whether women-owned small business concerns were solicited and, if not, why not; and
(7)If applicable, the reason award was not made to a small business concern.
(d)Records of any outreach efforts to contact:
(1)trade associations;
(2)business development organizations;
(3)conference and trade fairs to locate small, HUBZone small, small disadvantaged, service-disabled veteran-owned, and women-owned small business sources; and
(4)veterans service organizations;
(e)Records of internal guidance and encouragement provided to buyers through:
(1)workshops, seminars, training, etc.; and
(2)monitoring performance to evaluate compliance with the program’s requirements.
(f)On a contract-by-contract basis, records to support award data submitted by the offeror/subcontractor to LANS, including name, address and business size of each subcontractor. Subcontractors having commercial plans need to comply with this requirement.
12.The offeror/subcontractor agrees that it will:
(a)Make a good faith effort to acquire articles, equipment, supplies, services, or materials, or obtain the performance of construction work from the small business concerns that it used in preparing the bid or proposal, in the same or greater scope, amount, and quality used in preparing and submitting the bid or proposal.
(b)Provide Contractor with a written explanation, within 30 days of contract completion, if it fails to acquire articles, equipment, supplies, services or materials or obtain the performance of construction work as described in paragraph 12 (a) of this plan.
(c)Not prohibit a lower-tier subcontractor from discussing with Contractor any material matter pertaining to payment to or utilization of a lower-tier subcontractor.
(d)Pay its small business lower-tier subcontractors on time and in accordance with the terms and conditions of the underlying subcontract, and notify Contractor when it makes either a reduced or an untimely payment to a small business lower-tier subcontractor.
