The protest procedure for an Applicant who is not awarded a contract to protest an award or tentative award made by DPFS is allowed for competitive procurements. This procurement is non-competitive and cannot be protested as provided in1 TAC §391.301.

Amendment #1 Effective: March 19, 2015
Package 1 (Provider Enrollment for: Nursing Facility Services / 1.Section 2.8 of the open enrollment, Medicaid Application, contained language that read, in part, as follows:
“The Contractor must apply for the Client’s Medicaid eligibility determination within five (5) days from the first day of residential care for the client.”
