Food Waiver and Indemnification Agreement

FOOD WAIVER AND INDEMNIFICATION AGREEMENT

This Agreement is entered into as of August 4-5, 2017 by and between Enter organization name (“Organization”) and Georgia Tech Hotel and Conference Center (“Hotel”). In consideration of Organization’s execution of this Food Waiver and Indemnification Agreement (“Agreement”), Hotel hereby agrees to allow Organization to utilize an outside chef to prepare the following meals for Organization’s attendees.

HOTEL POLICY

It is the policy of this Hotel to discourage Hotel customers from purchasing food from outside the Hotel’s food chain and from using the Hotel facilities to prepare or to prepare and serve food to Hotel guests. Improper handling of food may lead to food poisoning and other health hazards. In the event that Organization requires the purchase, preparation, or serving of food by persons other than Hotel employees, the Hotel may allow such activity or activities only if Organization acknowledges, by their signature of this Agreement that they accept the responsibility and shall abide by the terms set forth in this Agreement.

WAIVER

The undersigned Organization agrees to waive any claim for damages of any nature whatsoever and to release the Hotel, the Hotel owner, Crestline Hotels & Resorts, LLC as agent for ARC Hospitality TRS Ga Tech LLC, and each of their respective subsidiaries, affiliates, officers, directors, employees and agents (collectively, “Indemnified Parties”) from any liability or responsibility whatsoever for any ill-effect, injury, or loss incurred by Organization or any third party including, but not limited to, all manner of actions, causes of action, suits, debts, damages, claims, demands, costs, losses and expenses of any type or kind whatsoever, arising from, connected with or related to the purchase of food and the preparation or serving of food to Organization or Hotel guests by persons other than Hotel employees.

INDEMNIFICATION

Organization agrees to indemnify, defend and hold harmless the Indemnified Parties from and against all liability, claims, actions, causes of action, suits, demands, damages, judgments, costs, losses and expenses, including reasonable attorney’s fees, to which any of the Indemnified Parties may be subject, including, but not limited to, any claim for any injury to or the sickness or death of any person or persons, or for damages to property or otherwise, arising from, connected with or related to the purchase of food and the preparation, serving or consumption of food by/from/to Organization and Hotel guests by persons other than Hotel employees.

GENERAL CONDITIONS

1. Items dispensed are limited to products manufactured or processed by exhibiting firms and are related to the purpose of the show.

2. All items limited to SAMPLE SIZE.

a. Non-Alcoholic beverages limited to maximum of 6oz.

b. Food items limited to maximum of 6oz.

3. The Organization named below acknowledges they have sole responsibility for the use, sale, servicing or other disposition of such items in compliance with all applicable laws. Accordingly, the Organization agrees to indemnify and forever hold harmless Georgia Tech Hotel and Conference Center from all liabilities, damages, losses, costs or expenses directly or indirectly from their use, sale, serving or other disposition of such items.

4. Georgia Tech Hotel and Conference Center will not provide facilities for storage of any food item hot or cold.

5. Other food and/or beverage items used as traffic promoters (i.e. coffee, soda, bottled water, popcorn, etc.) MUST be purchased from Georgia Tech Hotel and Conference Center.

ORGANIZATION’S ACKNOWLEDGMENT

Organization’s signature below indicates that Organization has read and understood this Agreement and agrees to its contents. Organization also acknowledges that the person signing on behalf of Organization is authorized to bind Organization to the terms of this Agreement.
