Sir, in this humble statement I, S.I Md. Shamsuddin Bhuyian, Thana Chandgao, CMP, Chittagong, on 24/04/2006 at 11.30 with S.I Md. Abu Yousuf, A.S.I Md. Nasir Uddin Biswas and with Ka – 1441 Abu Jahar, Ka – 1347 Harichand Biswas, Koi – Ansar 789 Harun – Ur – Rashid, Ka – 827 Abul Kashem, Ka – 2058, Kalo Moni Chakma, Ba Anshar and 312 Askar Ali are present at the Thana regarding this matter and are lodging a complaint that last 23/2/2005 at 19.10 an unknown individual telephoned to inform that, in Khalukat Industrial Area which is under the Thana, KTS Textiles And Garments was on fire. Based on this information I, the mobile duty officer who was on duty under this Thana and the force at about 19.30 arrived at the scene and saw that the 4 – storey stated factory building including the ground floor and 1st/2nd/3rd floors were on fire. Upon receiving the news the fire brigade was already present at the scene. We, the fire brigade and with the help of the local people tried to bring the fire under control. But because the stated institute’s main gate and other gates were closed it was not possible to put out the fire and failed in attempts to rescue. We and local people helped the fire brigade and with bamboo, ladder, rope etc. we lifted people up to the stated factory’s 1st/2nd/3rd floors and broke a couple of iron grills on the windows and almost 250/300 male/female workers were successfully brought out. Other than that more workers were successful in getting out through their own endeavors. Amongst the rescued workers 57 men/women workers with burns were sent to the Chomak Hospital’s emergency department by an ambulance. By that time 7 (seven) workers had received first aid and they had left the hospital. We found out that of the 50 men/women under treatment 1 (one) female worker died while receiving treatment. With the help of the fire brigade and local people after a long time the fire came somewhat under control. Of the dead workers 47 (forty – seven) were women and 4 (four) men, in total 51(fifty - one) burnt dead bodies were sent to the Chomak Hospital’s emergency department. At the Chittagong Medical College’s Emergency Department, Paclish Thana’s Officer wrote the on spot report for the dead bodies and for the autopsy investigation the bodies were sent to the morgue and they accepted all the responsibilities of the bodies. Because of the fire at the stated KTS Textiles and Garments various machinery, clothes and other furniture were damaged in the fire. After questioning the local people and garment workers it came to be known that last 23/02/2006 in the afternoon at 18.45 the fire started. But no one could say for sure how the fire started. It came to be known that at the garment factory approximately 1000/1200 men and women worked the day and night shift. It came to be known that on the day of the incident the day shift consisted of approximately 500/600 men and women who were working. Because of the fire at the stated institute/organization the workers who were working could not get out because the garments main exit, other exits and collapsible gate were locked. The workers who had been working could not get out of the factory in time. It has come to be known because of this fire a total of 52 (fifty – two) workers have died so far. Because the factory authority had not complied with the rules and regulations and therefore had not provided sufficient space for employees inside the factory to enter and exit, and since the main gate, other gates and collapsible gate were locked, the workers working inside the factory could not get out. As a result of the fire other than the tragic deaths many workers were severely injured because of the fire’s blaze and high temperature. The owners, authority and employees in due order are accused – (1) Md. C/A KTS Textiles and Garments Ltd., Falughat Bishik Industrial Area, Thana – Chandgao Zilla – Including Chittagong all other unknown officers/employees, because of their negligence, carelessness, because there was no alternative safe exit and the gate man was not at the gate and because of the premeditated locking of the gate innocent workers died and sustained severe injuries as a result of the fire and on account of the stated accused, a case should be filed under Penal Code sections 338/304/304 – A/34. It is highlighted that because of trying to rescue the injured and dead people at the scene of the incident there has been a delay in giving the case. Or I express the desire to file a regular case against the described accused under Penal Code sections 338/304/304 – A/34.
