Fines and Fees Policy

The Hinckley Public Library District has established the following schedule of fines for overdue materials as well as fees for other services provided by the Hinckley Public Library District.

Fines on Overdue Materials:

Books: 10¢ per day, not to exceed the cost of the item, with a one day grace period.

Audio Books: 10¢ per day, not to exceed the cost of the item.

Periodicals:10¢ per day, not to exceed the cost of the item.

Kits: $1.00 per day, not to exceed the cost of the item.

DVDs: $1.00 per day, not to exceed the cost of the item.

Interlibrary Loan materials:Determined by the lending library.

Music CDs: $1.00 per day, not to exceed the cost of the item.

All Other Items: 10¢ per day, not to exceed the cost of the item.

Patrons with overdue materials in any format are also responsible for any and all collection (including postage) and/or court costs incurred by the library in its efforts to secure the return of the material.

Fees:

Copies: 10¢ per page for black and white or 25¢ per page for color. If enlargement or reduction is required by the patron, the per page fee applies to each step in that process. Enlargement and reduction is not an exact science and may take several pages.

Fax/transmission: $1.00 per page. The cover sheet is excluded from the per page fee if the fax (including cover sheet) is more than one page in length.

Fax/receipt:10¢ per page. The Hinckley Public Library District assumes no responsibility of notification of the receipt of a fax for an individual. The fax will be held by the library for one week and then discarded if not picked up. No effort to notify the individual of the arrival of the fax will be made.

Computer printouts: 10¢ per page for black and white or 25¢ per page for color. This fee applies to all material printed by library printers including, but not limited to, Internet downloads, personal work, and graphics.

Internet usage: Free, except for printing charges.

A/V Returned to Outside Book Return: $5.00 per item.

Interlibrary Loan Materials: $1.00 per item ordered and received but not picked up by a patron within one week of notification of said item’s availability.

DVD loans: New DVDs: $1.00 fee/3 days. Other fiction DVDs: $1.00 fee/week. TV series: $2.00 fee/2 weeks. Nonfiction and older fiction DVDs are free to check out.

Lost or Damaged Materials:

The Board of Library Trustees is invested with the specific power under the Public Library Act to provide fines and penalties for injury to any book or other library material, or to any real or personal property belonging to

or in the custody of the library, and for failure to return any book or other material or personal property belonging to or in the custody of the library and to exclude from the use of the library any person who willfully violates the rules prescribed by the Board. The purpose of this policy is to prevent, discourage, and prohibit the injury to any book or library material or property, real or personal, and the failure to return any book or library material or property to the library.

Materials borrowed via any mechanism are the responsibility of the library patron. Replacement cost (not original purchase price) is the responsibility of any patron who borrows and loses any library material. In the case of children under the age of 18, it is the parent’s/guardian’s responsibility to pay for lost or damaged items in accordance with the following schedule of terms:

  • Retail replacement cost of any item, which is lost or damaged beyond repair and for which a current price can be found. Average replacement cost for any item, which is lost or damaged beyond repair and for which a current price cannot be found. A processing fee of $7.50 will be added to each item.
  • Materials borrowed through interlibrary loan, which are lost or damaged are charged to the patron according to the bill provided by the lending agency.
  • Lost magazines – cost of the magazine plus the processing charge.
  • Lost vertical files will be charged at $2.00 plus processing fee or cost of VF material, whichever is higher.
  • If CDs for audio books are lost or damaged and purchase cannot be made of only the lost or damaged CD, the cost will be the same as if the entire set of CDs were lost plus the processing fee.
  • Minor repair (in-house) or item damaged beyond repair will be determined at the director’s discretion.

The term "replacement cost" is the price the library must pay to obtain another copy of the item, as listed on Amazon.com or Baker & Taylor. If the particular title is no longer available, the cost is a figure based on the average price of such an item so that the library may obtain another title of a similar nature.

As to lost materials, the Library will utilize a refund policy on the following terms: cataloged books, CDs, and DVDs may be returned within six (6) months for a refund of the value or replacement cost paid subject to the rules relating to damaged materials and fines for overdue material IF the item has not already been replaced. If the item has been replaced, the patron may keep the item and no refund will be made. The service charge of $7.50 will not be refunded.

In addition to the foregoing, in the event that any person fails to return any book or library material, in an undamaged condition, is determined to be willful, the director of the library shall report such violation to the State's Attorney for prosecution pursuant to the applicable terms of the Illinois Criminal Code and shall exclude such person from further use of the library or any privileges attendant thereto until full restitution to the library has been made. For purposes of this section, "willful" is to mean "without good cause."

All fines and penalties for the commission of injury upon the library, its grounds, or the property thereof shall be paid into the general fund of the library or the body enforcing this ordinance.
