Dear Mr. Belelai:

On April 22, 2016, SkyFye filed the above-captioned application for a new satellite space station. Pursuant to Section 25.112(a)(1) of the Commission’s rules, 47 CFR § 25.112(a)(1), we dismiss the application.

Section 25.112(a)(1) of the Commission’s rules, 47 CFR § 25.112(a)(1), requires the Commission to return, as unacceptable for filing, any application that is not substantially complete, contains internal inconsistencies, or does not substantially comply with the Commission’s rules. For the following reasons, we find SkyFye’s application is deficient and not substantially complete:

·  Section 25.114(a) requires an application for a space station authorization to include technical information about the proposed space station operations in the form of a Schedule S, together with narrative exhibits required by Section 25.114(d). SkyFye’s application did not include a Schedule S or any narrative exhibits.

·  SkyFye checked Item 17c of the Commission’s Application for Satellite Space Station Authorization, FCC 312 Main Form (Form 312) stating that SkyFye submitted a fee and attached FCC Form 159, but no fee was submitted nor was a FCC Form 159 attached.

·  SkyFye’s response to Item 35 of the Form 312 states that SkyFye seeks waivers or exemptions of the Commission’s rules. SkyFye, however, does not attach as an exhibit its requests for waivers or exemptions, or specify what waivers or exemptions it seeks, as required by Item 35.

·  SkyFye’s response to Items 29 and 30 of the Form 312 states that SkyFye is a representative of a foreign government and an alien or a representative of an alien. SkyFye, however, did not attach an exhibit identifying the aliens or foreign entities, their nationality, or their relationship to the applicant, as required by Item 34 of the Form 312.

Accordingly, pursuant to Section 25.112(a)(1) of the Commission’s rules, 47 CFR § 25.112(a)(1), and Section 0.261of the Commission’s rules, 47 CFR § 0.261, we dismiss SkyFye’s application.
