Mountain View Electric Association, Inc. (MVEA) has these comments about the following:

Description: Approva l is being requested to subdivide Lot 2, Block 1-Claremont Ranch, Filing #9A and develop a food restaurant with drive thru on the newly formed Lot 28, Block 1-Claremont Ranch, Filing #9B. This lot will have approximately 0.82 acre. The proposed commercial development is located east of Marksheffel Road and south of Constitution Avenue in Section 04, Township 14 South, Range 66 West.
This area is within MVEA certificated service area. MVEA will serve this area according to our extension policy. Information concerning connection requirements, fees and upgrades under MVEA line extension policy can be obtained by contacting the Engineering Department of MVEA.
MVEA will request utility easements from the developer for this commercial property in order to serve. If drainage and landscaping are designed in this parcel MVEA requests these areas be listed to include utilities.
MVEA has existing facilities near and within this parcel of land. If there is any removal or relocation of facilities it will be at the expense of the applicant.

PIKES PEAK REGIONAL BUILDING DEPARTMENT
Regarding a request for approval of a development plan at 2457 N Marksheffel Rd., Enumerations has the following comments: 1. The development plan is calling this Lot 2B of Claremont Ranch Filing No. 9B, however, the plat submitted for Filing 9B (under separate submittal) shows only adjustments to existing lots from Filing 9A, not dividing Lot 2 into 2 separate lots. Clarify how the 2 lots shown in this development plan will be created. 2. The address for Lot 2 of Claremont Ranch Filing No. 9A is 2457 N. Marksheffel Rd. This address most likely can be used for proposed Lot 2B, with a new address being assigned to proposed Lot 2A, unless for some reason the developer wants to use that address for Lot 2A and assign a new one for this lot. 3. Secondary structures such as trash enclosures and signs will be assigned separate address as needed at time or plan submittal. Floodplain has no comment or objection to this submittal. COLORADO SPRINGS UTILITIES
Utility Comments (electric, gas) – first review
Action Items:
1. Revise the easements with proper Reception numbers per Plat comments.
2. Show and label existing gas main
3. Contact CSU Field Engineer (Ginny Halvorson at 719-668-5567) for location of proposed gas and electric services or main extensions.
4. Label property line between lots 2A and 2B.
5. Provide 5-foot public utility easements on each side of the property line between Lots 2A and 2B
6. Trash enclosure cannot be in the side lot easements. Revise as necessary.
7. Show and label proposed property line between Lots 2A and 2B on Plat.
General Information Items:
1. Please contact Utilities Development Services (UDS) at 719.668.8111 for an estimate of development charges, fees, Recovery Agreement Charges or other utility related costs that may apply to this development.
2. CSU requires an Application for Gas and Electric Line Extension to be submitted along with a Load Data form or an Application for Gas Service Line Approval and/or Application for Elevated Pressure Approval prior to electric and natural gas system design for service to the project. Refer to the CSU Line Extension and Service Standards or contact Field Engineering at 719-668-4985.
3. CSU may require an extension contract and payment of contributions-in-aid of construction (or a Revenue Guarantee Contract) for the extension of electric facilities needed to serve the development. Regarding natural gas extensions, CSU may require an extension contract and an advance payment for the estimated cost to construct the necessary gas extensions.
4. Improvements, structures and trees must not be located directly over or within 6 feet of any underground gas or electric distribution facilities and shall not violate any provision of the National Electric Safety Code (NESC) or any applicable natural gas regulations or Colorado Springs Utilities’ policies.
5. Improvements, structures and trees shall not be located under any overhead utility facility, shall not violate NESC clearances, and shall not impair access or the ability to maintain utility facilities.
6. Landscaping shall be designed to provide the required clearances for utility facilities, to allow continuous access for utility equipment, and to minimize conflicts with such facilities.

COLORADO SPRINGS AIRPORT ADVISORY COMMISSION
Airport staff recommends no objection with the following conditions:
• Airport Activity Notice on plat; no further action is required.
• Plat notes no. 24 and no. 25 are not accurate, replace with the following: based on elevation data, the applicant should file Federal Aviation Administration (FAA) Form 7460-1 “Notice of Proposed Construction or Alteration” for any new vertical development at this site, including temporary construction equipment, and provide FAA documentation to the Airport before the commencement of construction activities.
• More information about the airspace evaluation submittal process is available on the FAA’s Obstruction Evaluation/Airport Airspace Analysis website (https://oeaaa.faa.gov/oeaaa/external/portal.jsp).
ELPASO COUNTY HEALTH DEPARTMENT
Please accept the following comments from El Paso County Public Health regarding the project referenced above:
• Water and wastewater services will be provided by Cherokee Water and Sanitation District.
• There is sufficient wastewater treatment capacity at the Cherokee Water and Sanitation District wastewater treatment facility to treat the projected wastewater flows from this proposed .82 acre commercial lot (Starbucks).
• Radon resistant construction building techniques/practices are encouraged to be used in this area. The EPA has determined that Colorado, and the El Paso County area have potentially higher radon levels than other areas of the country.
• El Paso County Public Health requires the retail food service establishment interior finish plans to be submitted for review and approval by El Paso County Public Health.

Comments received from any of the above non-responding agencies following the issuance of this letter will be forwarded to the applicant/applicant’s representative and will be added to the end of this letter for record keeping purposes.
Due to the number of comments and necessary revisions to the plan(s) an additional detailed review will be necessary. Please address the comments as listed above. A detailed letter needs to accompany the revisions to allow for an expeditious re-review timeframe. The letter should include each comment listed above and, immediately thereafter, include a response from the applicant addressing the comment.
If any review agency has an issue that needs resolution or requires a revision, you will need to provide the necessary documents, drawings, etc., to the Planning and Community Development Department in the form of a resubmittal. The Planning and Community Development Department will then forward the resubmitted items directly to the appropriate review agency.
