Contractors and Suppliers agree to supply Partial and / or Final Lien Waivers along with each invoice in accordance with the forms attached, which provide that the waiver is not valid unless payment has been received by the Contractor, or Supplier. If payment is made by check, the check must have been successfully cashed. Blank Lien Waiver forms are provided as Exhibits 1 & 2.

Contractors and Suppliers stipulate that they know and understand the applicable building codes for the jurisdiction in question, that they are proficient at reading construction plans and specifications and that they are licensed to operate in their area of expertise in the State of Florida. As such, each Contractor and Supplier will point out to Epic Custom, LLC and to Hulsberg Engineering any deficiencies in the plans, code violations, or liabilities that would result from following such plans and specifications.

The scope of work, cost of labor and / or material provided is described in the attached Proposal as Exhibit 4 as accepted and executed by James P. Joyce, Manager, Epic Custom, LLC.

A retainage of 10% on all labor will be held till completion of construction.

Contractors and Suppliers agree to maintain standard Workers Comp and Liability Insurance coverages as outlined in Exhibit 3. Proof of coverage will be provided quarterly, or as requested by Epic.

All Contractors and Suppliers are to instruct their personnel thatSmoking is prohibited in Epic Homes and that all debris, bottles, cans, food containers and material scraps are to be placed in trash containers on a daily basis. Debris left on site is picked up by Jim Joyce, whose time is very expensive.

ALCOHOL consumption is strictly prohibited on any Epic job site.

While under construction, all Epic Homes are to be broom swept at least every other day. If more than one trade is on site at the same time, clean-up can be coordinated between the parties.

Safety rails on stairs and safety bars on windows will be installed as soon as possible during construction and will be immediately replaced after a task is completed that may have required the temporary removal of a safety rail or other safety device.

All personnel on site will comply with applicable OSHA safety guidelines, particularly the use of hard hats, safety lines on roof construction and proper bracing of any scaffolding. Eye and ear protection will be provided to workers in appropriate trades by the Contractor, or Supplier in question.

Exhibit 2. Contractor’s Partial Waiver/Release of Lien and Claims
