DELIVERY OF LOTS
The sale field will be open for the delivery of goods on Monday 9.00am to 6.00pm preceding the sale and on the sale day from 8.00am to 10.00am. A tractor and loader are available to assist unloading larger items, the unloading of items is entirely at the risk of the vendor.
CONDITIONS OF SALE/CLIENTS MONEY
I agree to be bound by the General Terms and Conditions as displayed within the Market/Sales offices. The Auctioneers act as Agent in all financial transactions. Sale proceeds are placed in a client’s bank account (HSBC, 251 High Street, Exeter) and are protected by the RICS Clients Money Protection Scheme (CMPS).
COMMISSION
Commission will be charged according to the price achieved being: 10% per lot that sells between £1 to £250, 7.5% per lot from £251 to £2500, and 5% per lot over £2500 per item plus VAT. The commission is inclusive of all organising and advertising costs. There is a minimum commission of £1 per lot plus VAT whether sold or unsold and a minimum commission per vendor of £5 plus VAT. There are no entry fees and the auctioneers will charge a 10% buyer’s premium on all lots £2,000 and under.
TITLE, HISTORY & FINANCE
You confirm that you have title to sell the items listed on this entry form and that you will keep Stags fully indemnified against the consequences of any adverse claim to title. If any machinery is not safe to use or has faults in any respect you undertake to disclose the defect to us in writing on this entry form and to keep Stags fully indemnified against the consequences of any failure to do so. Should a lot be proven to have been misdescribed/faulty by the vendor and subsequently the purchaser is refunded either from the auctioneers or from a credit card payment the vendor is liable to repay the monies back to the auctioneers. Please note that s75(1) Road Traffic Act 1988 makes it a criminal offence to offer for sale motor vehicles or trailers which are unroadworthy unless defects are indicated to buyers. All lots continue to be at the owners risk until the auctioneers have received and cleared payment for each lot. The owner therefore remains responsible for insurance against loss, damage or destruction until that time. If any items have outstanding finance please write details on this entry form.
