WHEREAS, Part II, Section V, Demil “B” and “Q” property, states in pertinent part that:
All property offered under this contract requires Mutilation, unless specifically excluded from Mutilation by the Government. The mutilation requirement includes metallic DEMIL Code “A” Property. DEMIL Code “A” property generally excluded from the Mutilation requirement includes: tires, lockers, ammunition cans, production stock/residue (bars, plate rod, wire, borings and turnings), wire and cable, pipe and tube construction material/residue (lumber, block, brick, window, I-beams), vehicles, wood products, furniture and white goods (appliances, e.g. refrigerators).
WHEREAS, in the interest of achieving cost savings for both the Purchaser and the Agency, the parties hereto mutually agree to modify Part II, Section V. to exempt non-demil required scrap classified in the following Standard Waste and Scrap Classification (SCL) Codes from the mutilation requirements:
C01(burlap),, C02(canvas), C03(rags), C04(webbing), C05(rope), C06(rayon),C07(nylon), C08(wool), C09(cotton), C10(silk), C1A(textile scrap, misc), C1B(cotton comforters), C1C(cotton mattresses), C1D(hawser), C1E({polyesters), C1F(poncho), C1G(rubberized clothing, C1H(Sleeping bags), CB6(baled/shredded rayon), CB7(baled/shredded nylon), CB8(baled/shredded wool), CB9(baled/shredded cotton).
NOW, THEREFORE, it is mutually agreed between the parties hereto to this modification that:
- Purchaser will submit to the SCO a listing of NSN’s for each particular scrap accumulation. DRMS will review and provide concurrence to the Purchaser.
- Upon DRMS concurrence, Part II, Section V. of the IFB is hereby modified to exempt the Contractor from mutilating non-demil required textile scrap within that particular scrap accumulation.
- Textile scrap is identified in the following SCL Codes: C01(burlap),, C02(canvas), C03(rags), C04(webbing), C05(rope), C06(rayon),C07(nylon), C08(wool), C09(cotton), C10(silk), C1A(textile scrap, misc), C1B(cotton comforters), C1C(cotton mattresses), C1D(hawser), C1E({polyesters), C1F(poncho), C1G(rubberized clothing, C1H(Sleeping bags), CB6(baled/shredded rayon), CB7(baled/shredded nylon), CB8(baled/shredded wool), CB9(baled/shredded cotton).
- The Purchaser acknowledges and agrees that non-demil requiredtextile scrap receivedidentified as Munitions List Items (MLI) or Commerce Control List Items (CCLI) will maintain the identity of Munitions List Items (MLI) or Commerce Control List Items (CCLI) and requires the Purchaser to submit to the SCO a properly completed End Use Certificate (EUC) and obtain a Trade Security Control Clearance.
- All other applicable terms and conditions of the contract remain in effect, including but not limited to Parts I-VI, and Articles One (1) through Twenty-Three (23); and
- This modification will become effective upon the date of the last affixed signature to this modification.
