IT IS AGREED that this Formal Instrument of Agreementshall constitute the contract between the parties.
WITNESS that:
1.This formal instruction of agreement outlines the Artist’s involvement with the City’s Central Greenough Artist in Residence Program as a guest artist and presenter.
2. Aim of Involvement
[For example: “The aim of the Artist’s involvement with the City’s Central Greenough Artist in Residence Program is to create poetry/words that reflect the lifestyle, history and environment of farmers and other residents of Greenough, and to undertake the Community Activities detailed below. In addition, the Artist may explore the nineteenth-century component of Central Greenough through a variety of mediums.”]
3. Community Activities
The Artist will undertake the following Community Activities during the term:
- [For example: “The presentation of a Meet the Artist event at the Central Greenough Café.”];
- [For example: “An exhibition in the foyers of Queens Park Theatre.”]; and
- [For example: “A workshop for students at xxx School.”]
4. Artist Fee
The City agrees to pay the Artist a fee of $xxxx.xx(GST included).
The Artist isresponsible for taxation, superannuation, workers compensation, traveland health insurance. The Artist will provide a tax invoice to the City stating ABN or providing a signed Australian Tax Office Statement by Supplierform no later than fourteen days after the execution of this agreement.
5. Travel and Meals
The City agrees to book and pay for the Artist’s flights, forward the flight itinerary to the Artist, and pick up the Artist at the Geraldton Airport. If the Artist makes a change to the booking that incurs a fee, that fee will be deducted from the Artist’s fee. The Artist will be responsible for their own meals.
6. Accommodation
The City, in partnership with the National Trust, will provide xx nights accommodation for the Artist at the Central Greenough Teachers Quarters. The Artist is to keep the accommodation clean and leave it in the same condition as found upon arrival.
7. Equipment
The Artist is to provide the City with a list of equipment needs, if applicable.
8. Promotion and Publicity
Promotion and publicity for the Artist’s aforementioned Community Activities will be the responsibility of the City with the Artist’s cooperation where required.
9. Copyright
The Artist, community participants and City will have joint copyright on all works created as part of the aforementioned Community Activities. All reproductions of workfor publicity and documentation shall properly credit the Artist, City, National Trust, and sponsors.
10. Documentation
Both parties agree that the aforementioned Community Activitiesmay be documented withphotographs, audio and video recordings and written reports.
11. Insurance
The City covers City facilities and City events for public liability. The City does not cover the Artist for incidents caused by his/her ownnegligence.
12. Modification
This agreement constitutes the entire understanding of theparties. Its terms cannot be modified except by a further agreement in writing signed by
both parties.
