AND WHEREAStheVendordothherebycovenantwiththesaidpurchaserthat he,the Vendorhavegoodright,title,interest and full powertogrant,convey andassign thesaidpieceandparcelofproperty moreparticularly describedintheSchedule hereunder and delineatedinthe planattached heretoandcoloured...... thereoninthe manneraforesaid andthatthesaidproperty isfreefromall encumbrances,claims,demandsandother courtattachmentsandthatthePurchaser may quietly enterinto and enjoythesame,therents and profits ofthesaid property withoutanylawfulinterruption,claims,demandor disturbancewhatsoeverfromthesaid vendororany otherpersonorpersonsclaimingthrough,underorintrust forthesaid Vendor.Andthatfreeandclearandfreely andclearly andabsolutely acquitted, exonerated,released and forever dischargedor otherwisebythevendor andsufficiently saved,defended,kept harmlessandindemnifiedof, fromandagainstallformer and otherestates,titles andchargesand/orencumbranceswhateverhadmade,executed, occasionedorsufferedbytheVendor orby any otherpersonorpersonslawfully or equitablyclaimingortoclaimby,from,underorintrustforthemoranyofthemwiththe
vendorand allpersonshavingorlawfully orequitably claimingany estate,right,titleor interestinlaw orinequity inallsaidproperty hereby assigned,transferredorany part thereof by,fromor in trust for thevendor or his successors, assigns andrepresentatives shallandwill from timeto time.
ANDtheVendor doth hereby covenantwiththePurchaserthat notwithstanding any act,deed,matters orthingswhatsoeverbytheVendororby any personorpersons lawfullyorequitablyclaimingby,from,through,underorintrustforhim,made,done, committed orknowingly orwillingly sufferedtothecontrary,hisright,title orinterestto thesaidpropertynotbecomingvoidorvoidableortheVendordothherebycovenant withthePurchaserthatthereisno mortgage, chargeorlienorotherencumbranceson thesaidproperty andtheVendordothhereby furthercovenantwiththePurchaserthat thePurchaser,itsvisitors,servants,agentsandlicencesfromtimetotimeandatall timeshereafterbydayandnightatitsortheirfreewillandpleasureforallpurposes connectedwiththeuseand enjoymentofthesaid property hereby conveyed,and assuredor expressed sotobetogotoreturn,passandre-passwithorwithoutvehicles ofall descriptions(includingmechanically propelledvehicles)ladenorunladenandwith orwithoutanimals overthecommonroad andthe Vendordeclarethathehas handed overtothePurchaseralldocumentsoftitlerelatingto,belongingtoorconnectedwith thesaid property andtheVendordeclare andconfirmthathedoes not have any other documentoftitleandshould hecomein possessionofany evidenceordocumentofor relatingtotitle, heshallandwillhandover orcausetobehandedovertothePurchaser or anypersonclaimingthroughor under thePurchaser.
AND,lastly theVendordothhereby confirmthat he hadhandedoverto and placedthePurchaser inpossessionofthesaidproperty herebygranted,conveyed, transferredand assigneduntothe Purchaser.
AND THE VENDOR DOTH HEREBY FURTHER COVENANT with the said
PurchaserthatwheneverreasonablyrequiredbythesaidPurchaserandatthecostof
the Purchaser,theVendorwilldosignandexecuteallotheracts,deeds andwritings for furtherandbetterassuringthesaidlandandproperly moreparticularlydescribedinthe Schedulehereunder andherebyconveyed tothesaidPurchaser.
