POSITION SUMMARY: Represent the State of Oregon in criminal cases, civil commitment hearings, juvenile delinquency cases, juvenile dependency cases, civil forfeitures proceedings and assist law enforcement in all types of investigations. While the work hours are from 8:00 a.m. to 5:00 p.m., plus 24-hour on-call duties for one-week intervals every five to six (6) weeks, this is a very demanding job requiring weekend and late night work to manage a complex and ever growing caseload. Supervision received: Works under the general supervision of the District Attorney and/or the Chief Deputy District Attorney. Supervision exercised: This position acts as a lead worker to assign work, review work, and provide training to lower level positions.
ESSENTIAL FUNCTIONS OF THIS POSITION: These examples do not include all the specific tasks that a DDA2 will be expected to perform: Prepare for litigation and then, in court, represent the interests of the people of the State of Oregon during grand jury proceedings, arraignments, preliminary hearings, pretrial motions, trials, sentencing hearings and post-conviction relief cases. Screen law enforcement reports and exercise prosecutorial discretion in making charging decisions and drafting charging documents. Research and write motions and supporting memoranda involving every aspect of criminal and civil litigation. Negotiate and draft plea agreements. Meet and with victims and witnesses in preparation for trial. Write or review affidavits in support of an application for search warrants. Other related duties as assigned.
MINIMUM QUALIFICATIONS: You must have graduated from an accredited school of law and be a member, in good standing, of the Oregon Bar. Further, you must have a minimum of three (3) years of legal experience and one (1) year of felony criminal litigation experience. You must have a strong knowledge of criminal law and the practices and procedures of criminal prosecutions, as well as knowledge of the Oregon Criminal Code, courtroom, trial procedure, trial tactics, and the Oregon and Federal civil procedure.
EXPERIENCE AND TRAINING: Juris Doctorate from an accredited law school, with at least three years of legal experience, and one-year experience litigating felony criminal cases; strong computer skills are absolutely essential.
NECESSARY SPECIAL QUALIFICATIONS: This position requires a valid OR driver’s license with a good driving record, and the use of a personal vehicle. This employee will be required to live in BentonCounty (a reasonable transition period to move is not a problem).
BACKGROUND INVESTIGATION: A thorough criminal background investigation is conducted and hiring is contingent on passing the investigation. Further, as is the case for all employees in the District Attorney’s Office, continued employment in this office requires a completely lawful lifestyle. Unbecoming conduct that brings this office into disrepute or reflects discredit upon the office or the individual working within the office is grounds for immediate termination.
